Allocation of Settlement Awards Between Wages and Non-Wages. Fifty Percent (50%) of each Settlement Award will be treated as wages and subject to normal payroll tax withholdings and payments, and these amounts shall be reported to the taxing authorities and the Settlement Class Members on IRS Forms W-2. Fifty Percent (50%) of each Settlement Award will be treated as non-wages (liquidated damages, enhancements, and prejudgment interest) on which there will be no tax withholding and for which IRS Forms 1099- MISC (marked “Other Income”) shall be issued to the taxing authorities and Eligible Settlement Class Members.

Allocation of Settlement Awards Between Wages and Non-Wages. One- third (33 1/3 percent) of the final Settlement Award to each Settlement Class Member will be allocated to wage claims (the “Wage Awards”) and thus will be subject to normal employee payroll tax withholdings and employer payroll tax payments. The other two-thirds (66 2/3 percent) of the final Settlement Award to each Settlement Class Member will be allocated to non-wage claims for prejudgment interest and exemplary damages (the “Non-Wage Awards”), as to which there will be no employee payroll tax withholdings or employer payroll tax payments.

None of the payments made to Qualified Class Members are to be construed as compensation for purposes of determining eligibility for any health and welfare benefits or unemployment compensation, and no benefits, including but not limited to pension and/or 401(k), shall increase or accrue as a result of any payment made or as a result of this Settlement, unless required by the plan documents or otherwise required by law.
