Eligible Settlement Class Members definition

Eligible Settlement Class Members means those Class Members who do not submit a Valid Exclusion Request.
Eligible Settlement Class Members means the Settlement Class members defined in Section 6.2.2 of this Agreement.
Eligible Settlement Class Members means any Settlement Class Member who is a Current Resident and any Settlement Class Member who submits a timely and complete Claim Form, or is otherwise determined by the Settlement Administrator to be eligible to receive a Cash Payment.

Examples of Eligible Settlement Class Members in a sentence

  • Fifty Percent (50%) of each Settlement Award will be treated non-wages (penalties, enhancements, and prejudgment interest) on which there will be no tax withholding and for which IRS Forms 1099 (marked “Other Income”) shall be issued to the taxing authorities and Eligible Settlement Class Members.

  • Fifty Percent (50%) of each Settlement Award will be treated as non-wages (liquidated damages, enhancements, and prejudgment interest) on which there will be no tax withholding and for which IRS Forms 1099- MISC (marked “Other Income”) shall be issued to the taxing authorities and Eligible Settlement Class Members.

  • It shall be the responsibility of the Contractor to remove and dispose of excess soil, and other matter created during execution of the project, such as but not limited to net backing of sod, roll tubes, pallets, etc.

  • Eligible Settlement Class Members may be entitled to a cash reimbursement payment from Honda by submitting a Settlement Claim to the Honda Administrator under the Customer Out-of-Pocket Expense Program.

  • Seventy-Five Percent (75%) of each Settlement Award will be treated non-wages (penalties, enhancements, and prejudgment interest) on which there will be no tax withholding and for which IRS Forms 1099 (marked “Other Income”) shall be issued to the taxing authorities and Eligible Settlement Class Members.

  • The Claims Administrator will assess and determine the validity of claims, subject to review by the Parties, and make pro rata Settlement payments to Eligible Settlement Class Members who submit a timely, valid Claim Form.

  • Eligible Settlement Class Members shall receive a refund of their out-of-pocket expenditures up to a 90-day NP Thyroid supply, but no less than Ten Dollars ($10.00) and no more than Fifty Dollars ($50.00), if the eligible Settlement Class Members postmark, electronically send, or otherwise send their refund request before December 1, 2024.

  • Except as otherwise provided in this Settlement Agreement, all approved payments to Eligible Settlement Class Members, the Class Representative, Class Counsel, and any other payments in connection with this Settlement, after the Effective Date, shall be made exclusively from the Escrow Account.


More Definitions of Eligible Settlement Class Members

Eligible Settlement Class Members means the top 500 claimants from the First Distribution and the Second Distribution based on claim value, and Late Claimants.
Eligible Settlement Class Members means the Named Plaintiffs, Opt-in Plaintiffs, and the servers and bartenders employed by Defendants between September 1, 2014 and April 23, 2018 that are identified in Exhibit A.

Related to Eligible Settlement Class Members

  • Settlement Class Members means any member of the Settlement Class.

  • Settlement Class Member means each person and entity who or which is a member of the Settlement Class.

  • Settlement Class means, in respect of each Proceeding, the settlement class defined in Schedule A.

  • Settlement Classes means the Ontario Settlement Class and the Quebec Settlement Class.

  • Qualified Settlement Fund or “Settlement Fund” means the interest-bearing, settlement fund account to be established and maintained by the Escrow Agent in accordance with Article 5 herein and referred to as the Qualified Settlement Fund (within the meaning of Treas. Reg. § 1.468B-1).

  • Settlement Class Counsel means the law firm of Xxxxxx Xxxxxx Xxxxx Xxxxxxx LLP.

  • Gross Settlement Fund means the Settlement Amount plus all interest earned thereon.

  • Settlement Class Period means the period from March 3, 2018 through February 10, 2022.

  • Individual Settlement Payment means the amount payable from the Net

  • Class Members means all individuals in the Settlement Class, including the Class Representatives.

  • Participating Class Members means all Class Members who do not submit valid

  • Gross Settlement Amount means $240,000 which is the total amount Standard agrees to pay under the Settlement, except as provided in Paragraph 8 below. The Gross Settlement Amount will be used to pay Individual Class Payments, Individual PAGA Payments, the LWDA PAGA Payment, Class Counsel Fees, Class Counsel Expenses, Class Representative Service Payment and the Administrator’s Expenses.

  • Net Share Settlement Amount For any Settlement Date, an amount equal to the product of (i) the number of Warrants exercised or deemed exercised on the relevant Exercise Date, (ii) the Strike Price Differential for the relevant Valuation Date and (iii) the Warrant Entitlement.

  • Purchase Contract Settlement Fund has the meaning specified in Section 5.5.

  • Participating Class Member means a Class Member who does not submit a valid and timely Request for Exclusion from the Settlement.

  • Physical Settlement Amount For any Settlement Date for which Physical Settlement is applicable, an amount in cash equal to the product of (a) the Forward Price in effect on the relevant Settlement Date multiplied by (b) the Settlement Shares for such Settlement Date.

  • Maximum Settlement Amount means the maximum amount the Company may be required to pay pursuant to this Settlement, which is the sum of Three Hundred Thousand Dollars ($300,000), excluding any of the Company’s employer-side share of FICA, FUTA, and other similar, mandatory employer-side payroll taxes. In no event shall the Maximum Settlement Amount exceed the foregoing sum.

  • Settlement Fund means the Settlement Amount plus any and all interest earned thereon.

  • Settlement Method Election Date With respect to any Settlement of any Transaction, the 2nd Scheduled Trading Day immediately preceding (x) the Valuation Date for such Transaction, in the case of Physical Settlement, or (y) the First Unwind Date for such Transaction, in the case of Cash Settlement or Net Share Settlement.

  • Cash Settlement Amount means the “Cash Settlement Amount” as determined by the Calculation Agent in accordance with Paragraph 6.

  • Net Settlement Fund means the Settlement Fund, plus accrued interest, less any award of attorneys’ fees or reimbursement of expenses and less applicable taxes, tax preparation expenses, and costs of notice and administration, that may be awarded or approved by the Court.

  • Structured settlement annuity means an annuity purchased in order to fund periodic payments for a plaintiff or other claimant in payment for or with respect to personal injury suffered by the plaintiff or other claimant.

  • Class Member means a member of the Class.

  • Net Share Settlement means the settlement method pursuant to which an exercising Warrantholder shall be entitled to receive from the Company, for each Warrant exercised, a number of shares of Common Stock equal to the Net Share Amount without any payment therefor.

  • Settlement Funds means moneys allocated to this state from the environmental mitigation trust specified in par. (d) and received by the state from the trustee.

  • Cash Settlement shall have the meaning specified in Section 14.02(a).
