Amendment of Information. The MCP shall make any amendment(s) to PHI as directed by, or agreed to, by ODM pursuant to 45 CFR 164.526, or take other steps as necessary to satisfy ODM’s obligations under 45 CFR 164.526. In the event that the MCP receives a request for amendment directly from an individual, agent, or subcontractor, the MCP shall notify ODM prior to making any such amendment(s). The MCP’s authority to amend information is explicitly limited to information created by the MCP.

Amendment of Information. Contractor shall make any amendment(s) to PHI as directed by, or agreed to, by ODH or take other steps as necessary to satisfy ODH’s obligations. In the event that Contractor receives a request for amendment directly from the individual, agent, or subcontractor, Contractor will notify ODH prior to making any such amendment(s). Contractor’s authority to amend information is explicitly limited to information created by Contractor.

Any denial of amendment to PHI determined by Covered Entity pursuant to 45 CFR Section 164.526, and conveyed to Business Associate by Covered Entity, shall be the responsibility of Covered Entity, including resolution or reporting of all appeals and/or complaints arising from denials. Within ten (10) business days of receipt of a request from Covered Entity to amend an individual’s PHI in the Designated Record Set, Business Associate shall incorporate any approved amendments, statements of disagreement, and/or rebuttals into its Designated Record Set as required by 45 CFR Section 164.526.
