Application-oriented projects. The owner of results [of application-oriented projects] is Software Competence Center Hagenberg GmbH. Rights within the areas of interest defined by Company Partners Software Competence Center Hagenberg GmbH guarantees that all Company Partners participating in a project at the time of completion of its results can enjoy, without licensing fees or time restrictions, the rights to any form of utilization of the results for the Company Partner’s interest area as defined in the declaration of accession to the Agreement, and that such rights shall be freely transferable by way of sublicenses. Such rights of Company Partners to grant sublicenses for utilization of results in their de- fined area of interest can also be transferred to third parties. In the application domain of the copyright, this means that all Company Partners participating in the project at the point of completion of the results shall enjoy, without licensing fees or time restrictions, the rights to any form of utilization of the results for the Company Partner’s interest area as defined in the respective declaration of accession to the Agreement and such rights shall be freely transferable in this area of interest. In the event of any overlapping of areas of interest on the part of Company Partners, the Company Partners shall enjoy the same rights in the area of intersection, unless they agree in ad- xxxxx to different regulation, formulated in writing, to govern the manner and degree of corresponding utilization and exploitation rights. Should a Company Partner be in arrears with payments in accordance with the Agreement where such payments relate to the respective project, then such Company Partner shall enjoy the above mentioned rights to the results of this project only after complete payment of the amount in arrears. Software Competence Center Hagenberg GmbH further guarantees all Scientific Partners engaged in the project at the time of completion of the results the irrevocable, nonexclusive, nontransferable right of utilization, without licensing fees or time restrictions, within the areas of interest defined in the Com- pany Partners’ respective declarations of accession to the Agreement, to the results achieved by the respective Scientific Partner for further In-House Research and for Contract Research on the part of the respective Scientific Partner.   • Project Initiation i - Upon final execution of the Agreement with the DISTRICT, the ARCHITECT shall: ♦ Review the Program Management Plan (PMP) with the DISTRICT and its representatives to familiarize them with the proposed tasks and schedule and develop necessary modifications. The PMP defines the Program Master Schedule and Budgets and each Project scope and budget.

  • RENTAL APPLICATION The Tenant acknowledges that the Landlord has relied upon the rental application, a copy of which is attached hereto, as an inducement for entering into this agreement, and the Tenant warrants to the Landlord that the facts stated in the application are true to the best of Tenant’s knowledge. If any facts stated in the rental application prove to be untrue, the Landlord shall have the right to terminate the residency immediately and to collect from the Tenant any damages resulting therefrom.
