Appointment of Independent Engineer. The Authority shall appoint a consulting engineering firm from a panel of 10 (ten) firms or bodies corporate, constituted by the Authority substantially in accordance with the selection criteria set forth in Schedule-P, to be the independent consultant under this Agreement (the “Independent Engineer”). The appointment shall be made no later than 90 (ninety) days from the date of this Agreement and shall be for a period of 3 (three) years. On expiry or termination of the aforesaid period, the Authority may in its discretion renew the appointment, or appoint another firm from a fresh panel constituted pursuant to Schedule-P to be the Independent Engineer for a term of 3 (three) years, and such procedure shall be repeated after expiry of each appointment.
Appointment of Independent Engineer. The Nodal Agency shall appoint an agency/ company as Independent Engineer as per framework provided in the Guidelines for Encouraging Competition in Development of Transmission Projects for selection of Independent Engineer.
Appointment of Independent Engineer. The Authority shall appoint a consulting engineering firm substantially in accordance with the selection criteria set forth in Schedule-M, to be the independent consultant under this Agreement (the “Independent Engineer”). The appointment shall be made no later than 60 (sixty) days from the date of this Agreement and shall be for a period of Construction Period plus six (6) months).On expiry or termination of the aforesaid appointment, the Authority shall appoint an Independent Engineer for a further term of 3 (three) years in accordance with the provisions of Schedule-M, and such procedure shall be repeated after expiry of each appointment.
Appointment of Independent Engineer. The Authority shall appoint a consulting engineering firm from a panel of 10 (ten) firms or bodies corporate, constituted by the Authority substantially in accordance with the selection criteria set forth in Schedule-P, to be the independent consultant under this Agreement (the "Independent Engineer"). The appointment shall be made no later than 90 (ninety) days from the date of this Agreement and shall continue until two years from COD of Commercial Complex. After the completion of tenure of Independent Engineer all correspondences, permissions, submissions or any dispute(s) arising out of O&M obligations of Concessionaire as mentioned in this Concession Agreement shall be brought to the Maintenance Committee. The decision of the Maintenance Committee in this behalf shall be made in accordance with the provisions of Concession Agreement. For the additional work(s) in Bus Terminal in accordance with Article 16, the Authority shall appoint a consulting engineering firm, to be the consultant under this Agreement (the "Additional Engineer"). Notwithstanding anything to the contrary contained in this Article, the Authority may in its discretion appoint a government-owned entity as the Additional Engineer; provided that such entity shall be a body corporate having as one of its primary function the provision of consulting, advisory and supervisory services for engineering projects.
Appointment of Independent Engineer. The Authority shall appoint a consulting engineering firm from a panel of 3 (three) firms or bodies corporate, mutually constituted by the Authority and the Concessionaire, to be the independent consultant under this Agreement to certify the Construction Works of the Hospital in accordance with this Agreement (the "Independent Engineer"). The appointment shall be made no later than 180 (one hundred and eighty) days from the Execution Date and shall expire upon NABH accreditation in accordance with Clause 21.4.
Appointment of Independent Engineer. The Authority shall, in consultation with the Concessionaire appoint a consulting firm/consultant from a panel of [●] consultants/ firms or bodies corporate, constituted by the [Authority/Concessionaire] substantially in accordance with the selection criteria set forth in Schedule-Q, to be the Independent Engineer under this Agreement. The appointment shall be made no later than 90 (ninety) days from the date of this Agreement and shall be for a period of 3 (three) years. On expiry of the aforesaid period, the Authority may in its discretion renew the appointment, or appoint another firm from a fresh panel constituted pursuant to Schedule-Q to be the Independent Engineer for a term of 3 (three) years, and such procedure shall be repeated after expiry of each appointment.
Appointment of Independent Engineer. For the purposes of this ARTICLE III, Seller and the Buyer will appoint the Independent Engineer effective as from the Agreement Date. The Independent Engineer may be replaced upon the mutual agreement of Seller and Buyer at any time. The Independent Engineer shall act as independent engineer, reviewer, and certifier as contemplated in this Agreement. The Independent Engineer’s duties will include a duty of care to the Buyer’s Lender. The Independent Engineer will, among other things, witness the commissioning and testing of each Bloom System and the BOF Work pursuant to this ARTICLE III (the “Independent Engineer”). All fees and costs payable in respect of the Independent Engineer (including those incurred in making such appointment) shall be borne by Seller.
Appointment of Independent Engineer. 23.1.1 The Authority shall appoint a consulting engineering firm from the Independent Engineer Panel, on a limited tender basis, to be the independent engineer under this Agreement to certify the Construction Work of the Hospital in accordance with this Agreement (the “Independent Engineer”). The appointment shall be made within the time period specified in Clause 4.2.1(viii) or such extended period as may be mutually agreed between the Authority and the Concessionaire and shall expire upon 365 (three hundred and sixty-five) days of the COD of Phase-II.
23.1.2 In the event that the Concessionaire is required to or it agrees to, as the case may be, construct and develop any Additional Capacity in accordance with the terms of this Agreement, then the Independent Engineer shall be re-appointed for the construction period of the Additional Capacity. Such re-appointment shall be subject to the approval of the entity proposed to be appointed as Independent Engineer and the terms and conditions of its appointment.
Appointment of Independent Engineer. The Concessionaire shall appoint a consulting engineering firm from the approved panel of consultants of Zonal Railway, to be the independent consultant under this Agreement (the “Independent Engineer”). The appointment shall be made no later than [180 (one hundred and eighty)]days from the Effective date and shall be for a period of [1 (one)]year initially and shall be renewed till COD is achieved. On expiry of the aforesaid period prior to COD or termination of appointment of the Independent Engineer prior to expiry of the aforesaid period, the Concessionaire shall renew the appointment, or appoint another firm from the said panel, as the case may be, to be the Independent Engineer and such procedure shall be repeated after expiry or termination of each appointment till COD is achieved. Notwithstanding anything to the contrary herein, if during the Operation Period, the Concessionaire undertakes to perform the O&M of the Rail System on its own, it shall, if required by MOR, ensure that the appointment of the Independent Engineer is extended till the end of the Term.

MOR shall appoint a consulting engineering firm from a panel of 6 (six) firms or bodies corporate, constituted by MOR substantially in accordance with the selection criteria set forth in Schedule-M, to be the independent consultant under this Agreement (the “Independent Engineer”). The appointment shall be made no later than 90 (ninety) days from the date of this Agreement and shall be for a period of [3 (three)] years. On expiry or termination of the aforesaid period, MOR may in its discretion renew the appointment, or appoint another firm from a fresh panel constituted pursuant to Schedule-M to be the Independent Engineer for a term of 3 (three) years, and such procedure shall be repeated after expiry of each appointment.
