Appropriate Vacancy. 1.2.1 An appropriate vacancy is a position equivalent in level and Seniority Group, to the position held by an employee immediately prior to taking leave, and is a vacancy for which no other employee has rights. 1.2.2 Reassignment upon termination of general non-compensatory leave will occur only when an appropriate vacancy is available; no new employee shall be placed in a position which is an appropriate vacancy for an employee whose leave has expired, and who is awaiting return. 1.2.3 If no appropriate vacancy exists upon the termination of the leave, the employee’s name will be added to the list of employees awaiting reinstatement, for up to eighteen (18) months following the termination of the leave.
