Arbitration Hearing and Decision. The arbitration hearing shall be conducted as a full-scale evidentiary hearing with full due process rights including the right to present witnesses, present evidence, cross examine opposing witnesses, the right to counsel and findings to support the decision. Within thirty (30) days of the conclusion of the hearing, the Arbitrator shall render a written decision. The decision of the Arbitrator shall be provided to both parties. Any decision of the Arbitrator shall be binding to both parties. The decision of the Arbitrator shall be final subject only to judicial review pursuant to the Code of Civil Procedure Section 1094.6.
Arbitration Hearing and Decision. The Arbitrator shall hear the submitted grievance(s) as expeditiously as possible, but no longer than one hundred twenty (120) days from formal request for arbitration, and shall render a decision in writing within thirty (30) days after the conclusion of the last hearing date or submission of briefs, whichever is later. If the matter is not heard within one hundred twenty (120) days solely due to Employer delay, the Union shall prevail on the grievance.

The arbitration hearing of a claim shall commence no later than six (6) months after the date the arbitrator is selected and shall continue on consecutive business days until completed unless the parties and the arbitrator agree to a different schedule. The hearing shall be held in Westborough, Massachusetts. Each party shall have the right to present testimony from its witnesses and to cross-examine witnesses presented by the other party. The hearing shall be stenographically recorded and each party shall have the right to submit post-hearing briefs within the time period set by the arbitrator. The arbitrator shall issue his/her award within sixty (60) days of close of the hearing or receipt of briefs and shall submit with the award an opinion which shall include findings of fact and conclusions of law.
