ASSOCIATION AND EMPLOYEE RIGHTS. A. The Board specifically recognizes the right of the Association to organize and operate under the Michigan Public Employment Relations Act and all other applicable laws and regulations. ASSOCIATION AND EMPLOYEE RIGHTS. A. KCEA—KBS shall meet with Association representativesalso be entitled to information which may be necessary to process a grievance or complaint. It is underst ood that this shall not be construed to require the District, at agreed upon timeswithout compensation by KCEA—KBS, to discuss problems compile information and concerns. ASSOCIATION AND EMPLOYEE RIGHTS. A. The Association, prior to the Board changing or adopting any major job classification duties, policy, or rule having direct and significant application to the personal employment conditions of employees covered by this Agreement, and/or will have to be implemented by and/or interpreted to the public by employees covered by this Agreement, shall be notified in writing sufficiently in advance of the scheduled Board action to allow the Association shall to make a recommendation to the Superintendent and have him/her consider it. ASSOCIATION AND EMPLOYEE RIGHTS. A. ASSOCIATION AND EMPLOYEE RIGHTS. A. Pursuant to the Michigan Public Employment Relations Act, the Board hereby agrees that every employee employed by the Board shall have the right freely to organize, join and support the Association for the purpose of engaging in collective bargaining or negotiations and other concerted activities for mutual aid and protection. As a duly elected body exercising governmental power under color of the law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage or deprive or coerce any employee in the enjoyment of any rights conferred by the Act or other laws of Michigan or the Constitutions of Michigan and the United States; the Board will not discriminate against any employee with respect to hours, wages, or any terms or conditions of employment by reason of his membership in the Association, his participation in any activities of the Association or collective professional negotiations with the Board, or his institution of any grievance, complaint or proceeding under this Agreement.

9.7 Prior to any public notification when a permanent job vacancy exists within the unit, it shall be posted for four (4) working days. Posting will show the job title, shift, and location of the opening and qualifications required for the job. A notation will be made if there are special duties required. Posting shall be accomplished by notification on bulletin boards and by e-mail. Internal applicants shall have four (4) working days in which to apply, shall place their applications in letter form, and shall forward copies to both the immediate supervisor of the position and the Human Resources Office. Selection of internal applications will be made from those qualified to fill the vacancy on the basis of qualifications to do the work required and seniority. If an internal applicant is not qualified, the College shall use its normal search and screening procedures. The name of the person appointed to the position will be announced to the college community within ten (10) working days from the date of appointment.
9.8 The Association shall have up to 150 paid hours (in addition to those referenced in Section 9.6) per year for the purposes of releasing Association officers and members to attend Association conferences or workshops.

ASSOCIATION AND EMPLOYEE RIGHTS. 2.1. The Board, prior to changing or adopting any major job classification duties or work rules having direct and significant application to the employment conditions of employees covered by this Agreement, will notify the Association, in writing, one week in advance of the scheduled Board action to allow the Association to make a recommendation to the Board and have it considered. The Board will elicit the opinion and recommendations of the Association.

2.4. The Board and Association agree that there shall be prompt and expeditious handling, at the local level, of a school-related complaint regarding an employee or other employees and/or personnel he/she supervises. It is agreed that normally such usage does not interfere with District operations. Requests complaints will be submitted through promptly referred to any employee affected, except in those instances where the nature and/or circumstances of the complaint indicate other handling procedures established by are in order. It is agreed that if the District and are subject complaint is not referred back to the provisions affected employee, he/she, in those instances of Board Policyschool related complaints where it is determined such necessary action can be delayed, shall be given an opportunity to provide the necessary background information, either in person and/or by confidential memoranda, before any action is taken on the matter.
2.5. Any costs above and beyond the building usage policy incurred through such usage shall be assumed by the Association.
B. The Association administrator shall have the right to use District equipment (including copy machines, audio visual equipment, etc.) inspect his/her Central Office personnel file. The administrator must have an appointment with the approval of the Superintendent or his/her designeethe Director of Personnel in order that one or the other will be available when the administrator inspects the file. Any costs Confidential credentials and related personal references normally sought at the time of materials incurred in such usage shall employment or promotion are specifically exempted from review and will be assumed removed from the file prior to review by the Association. 9.6 JCCSA members shall incur no loss in pay for administering this agreement to include such things as processing grievances, negotiating contracts, and other items limited to the administration of this agreement.
9.7 When a permanent job vacancy exists within the unit, it shall be posted for four (4) working days. Posting will show the job title, shift, and location of the opening and qualifications required for the job. A notation will be made if there are special duties required. Posting shall be accomplished by notification on bulletin boards and by e-mail. Internal applicants shall have four (4) working days in which to apply, shall place their applications in letter form, and shall forward copies to both the immediate supervisor of the position and the Human Resources Office. Selection of internal applications will be made from those qualified to fill the vacancy on the basis of qualifications to do the work required and seniority. If an internal applicant is not qualified, the College shall use its normal search and screening procedures. The college retains the right to post a job vacancy through external sources simultaneously with the internal posting. The name of the person appointed to the position will be announced to the college community within ten (10) working days from the date of appointment.
9.8 The Association shall have up to 150 paid hours (in addition to those referenced in Section 9.6) per year for the purposes of releasing Association officers and members to attend Association conferences or workshops.
9.9 Each employee shall have the right to have an Association representative accompany them when they are required to meet with management regarding performance and discipline problems only. If a confrontation occurs during a meeting between an employee and his/her personnel filesupervisor without the presence of an Association representative, excluding confidential pre-employment references. At the unit member's option, employee may stop the meeting and call in a representative representative.
