D. The Association and its members shall have the right of reasonable use of school buildings, equipment internet, e-mail, and facilities when scheduled, with the approval of the administration. The Association and its members agree to reimburse the District for costs (excluding rental costs) associated with this use. E. The teachers, administration and Board will share in the responsibility of working with students to reduce misconduct and/or anti-social behavior. F. All communications directed to a teacher in the course of his professional duties and deemed by said teacher to be of a confidential nature need not, except with the consent of said teacher, be disclosed to anyone, including but not limited to any school administrator, parent or guardian, unless said disclosure has been determined to be required by law. In addition, confidential communications including student records information accessible to teachers shall not be disclosed except in conformance with state or federal law. G. The Association shall have the right to post notices of activities and matters directly pertaining to Association business on designated bulletin boards, at least one of which shall be provided in each building or facility to which bargaining unit members may be assigned. The Association may use, to the extent permitted by law, the internal document delivery service of the employer, without U.S. Postage, and employee mailboxes for communications to bargaining unit members.

The Association shall have the right to use the facilities and the office, audio-visual, and business equipment in the school buildings at reasonable times when such facilities and equipment are not otherwise in use. The Association may shall furnish or pay for the reasonable cost of all materials and supplies incidental to such use and will be responsible for the cost of repairs or any damage or loss directly attributable to inappropriate or improper use, and provided further that such repair or loss is not covered by insurance, warranty, and/or service agreements. G. The Board agrees to furnish to the extent permitted by lawAssociation, in response to reasonable requests, all available public information concerning the financial resources of the district as will assist the Association in developing intelligent, accurate, informed and constructive proposals on behalf of the teachers. H. Each teacher shall have the right, upon request, to review the contents of his/her personnel file in accordance with district policy and applicable statute. If the principal keeps an accumulated file, it should be open to the teacher. A representative of the Association may, at the teacher’s request, accompany the teacher in the file review. The teacher has the right to file a response to any material in the file, and this response shall become part of the personnel file. a. If the teacher’s personnel file contains information which the teacher believes is false, the internal teacher may utilize the contractual grievance procedure to have said material removed or destroyed. The parties understand that any document delivery service that includes “pc personnel file” will be regarded as inclusive of the employerpersonnel file by the parties on the date of the document. I. A teacher shall at all times be entitled to have present a representative of the Association when he/she is being reprimanded, without U.S. Postagewarned, or disciplined for any infraction of rules or delinquency of professional performance, and employee mailboxes when he/she is engaged in an investigatory interview from which it is reasonable to conclude that disciplinary action against him/her may result. When a request for communications such representation is made, no action shall be taken with respect to bargaining unit membersthe teacher until such representative of the Association is present. When a situation demands prompt attention, the Association shall provide a representative within forty-eight (48) hours of the request.

One member from each of the principal’s advisory committees, each of the building principals and one person designated by the Association will make up a Superintendent’s Advisory Committee. O. Upon their request the teacher shall be entitled to review the contents of their own personnel file, as provided by Michigan law. A representative of the Association may at the teacher’s request, accompany the teacher to this review. Materials provided by the teacher will be placed in the teacher’s file. No material that is disciplinary in nature may be placed therein without providing the teacher with a copy which shall be signed by the teacher to indicate receipt. This provision shall not prevent the District from responding to FOIA requests as provided by law. If the Board receives a request for any information or facility documents from a teacher’s personnel record, the Board shall notify the teacher and Association President as soon as possible. It is not the intent hereby agrees that every employee of the Board shall have the right freely to organize, join and support an Association to impede for the purpose of engaging in collective bargaining or negotiation and other lawful concerted activities for mutual aid and protection. No teacher shall be prevented from wearing insignias or pins as identification of membership in the Association whether on or off school premises. D. A Bulletin board in the teachers’ lounge shall be made available to the Association and its members. E. The Board, or its designee, agrees to furnish the Association in response to reasonable “written” requests, all available information concerning the financial resources of the district, and such other information which may be necessary for the Association to process any grievance or complaint, except information from personnel or medical files deemed to be confidential. F. Nothing contained herein shall be construed to deny or restrict to any teacher, rights he may have under the Michigan Revised School Code. The Association agrees that it rights granted to teachers under the master contract shall not discourage, deprive, coerce, harass or discriminate against any employee be deemed to be in addition to those provided by law. G. The salary committee of the Association may, with the approval of each teacher whose contract is being reviewed, check teacher’s contracts in the presence of a representative of the Superintendent to determine if the salary schedule is being followed. H. The Board recognizes that appropriate texts, library reference facilities, maps, and globes, laboratory equipment, audio-visual equipment, art supplies, physical education equipment, current periodicals, standard tests and questionnaires and similar materials are the tools of Education the teaching profession. The parties will confer from time to time for the purpose of improving the selection and use of such educational tools. The Board agrees at all times to keep the schools reasonably and properly equipped and maintained. I. The Board shall make available in each school adequate lunchroom space, restroom and lavatory facilities exclusively for teacher use and at least one room appropriately furnished, which shall be reserved for use as a faculty lounge. J. Classroom telephones are available to teachers for their reasonable use. K. Adequate parking facilities shall be made available to teachers for their assigned use. L. Teachers shall be entitled to full rights of citizenship and no religious or political activities of any teacher or the lack thereof shall be grounds for any discipline or discrimination with respect to the enjoyment professional employment of such teacher. The private and personal life of any rights conferred teacher is not within the appropriate concern or attention of the Board unless the teacher’s conduct shall adversely affect his professional status as determined jointly by the laws of the Constitution of Michigan Association and the United StatesBoard. C. M. Other materials required by the teacher may be requested by the teacher through the building principal and such request will be given prompt consideration. O. Teachers will be advised insofar as can be reasonably foreseen when any policy manual change directly related to the teaching staff is to be acted upon by the Board. The Association and its members shall have faculty will set up a principal’s advisory committee each semester in each of the right of reasonable use of school respective buildings, equipment internet, e-mail, and facilities when scheduled, with the approval of the administration. The Association and its members agree to reimburse the District for costs (excluding rental costs) associated with this use. E. The teachers, administration and Board will share in the responsibility of working with students to reduce misconduct and/or anti-social behavior. F. All communications directed to a teacher in the course of his professional duties and deemed by said teacher to be of a confidential nature need not, except with the consent of said teacher, be disclosed to anyone, including but not limited to any school administrator, parent or guardian, unless said disclosure has been determined to be required by law. In addition, confidential communications including student records information accessible to teachers shall not be disclosed except in conformance with state or federal law. G. The Association shall have the right to post notices of activities and matters directly pertaining to Association business on designated bulletin boards, at least one function of which shall be provided to provide a group with which the respective principal may consult in each building or facility relation to which bargaining unit members may be assignedthe forgoing and other matters pertaining to the school. The Association may usehigh school principal’s committee will be made up of three (3) members chosen by the high school faculty with no more than one (1) member from any subject area. Upon their request the teacher shall be entitled to review the contents of their own personnel file, as provided by Michigan law. A representative of the Association may at the teacher’s request, accompany the teacher to this review. Materials provided by the teacher will be placed in each building the teacher’s file. No material that is disciplinary in nature may be placed therein without providing the teacher with a copy which shall be signed by the teacher to indicate receipt. This provision shall not prevent the District from responding to FOIA requests as provided by law. If the District receives a request for any information or facility documents from a teacher’s personnel record, the District shall notify the teacher and Association President as soon as possible. Before any requested information from a teacher's personnel file is released, the Board will permit the teacher and Association representative the opportunity to review the file. P. Upon their request the teacher shall at all times be entitled to have present a representative of the Association when they are being reprimanded, warned or disciplined or at any meeting which the teacher reasonably believes may result in discipline. When a request for such representation is made, no action shall be taken with respect to the teacher until such representative of the Association is present. Any suspension without pay shall not affect in any manner the bargaining unit members may be assigned. The Association may use, to the extent permitted by law, the internal document delivery service of the employer, without U.S. Postage, and employee mailboxes for communications to bargaining unit membersmember’s insurance coverage and/or contractual fringe benefits.
