Assumption of Risk/Waiver. The Licensee understands that the COVID-19 is a highly contagious, dangerous, and potentially lethal disease. As such, the Licensee confirms that s/he is fully aware that living in McMaster’s residences and receiving the services of XxXxxxxx’x residences carries inherent risks related to COVID-19 and its transmission, which cannot be eliminated notwithstanding the care and precautions taken by the University to mitigate against such risks. The Licensee understands that the extent of such risks is not fully known and that they include but are not limited to: •coming into close contact with individuals that may carry and transmit COVID-19 to the guest; •coming into contact with objects that may carry and transmit COVID-19 to the guest •transmitting COVID-19 to other individuals; •injuries or illness, including death, arising from contact with COVID-19, contracting COVID-19 and/or its treatment.
Assumption of Risk/Waiver. PSAV and its employees and agents assume the risk of any loss or damage to their property left on or at the Convention Center. Neither ANAHEIM nor its officers, agents and employees shall be responsible or liable for loss of, or damage to the aforesaid property while on or at the Convention Center. PSAV acknowledges and waives any claim for damage or loss, including consequential damage, arising from the loss of use of any equipment at the Convention Center.
Assumption of Risk/Waiver. The Selected Provider and its employees and agents assume the risk of any loss or damage to their property left on or at the ACC facilities. Neither the City of Anaheim, nor its officers, agents and employees shall be responsible or liable for loss of, or damage to the aforesaid property while on or at the ACC facilities. Selected Provider acknowledges and waives any claim for damage or loss, including consequential damage, arising from the loss of use of any equipment at the ACC.

You understand and acknowledge that particular aspects of the Burlexercise Instructor Course, will include physical activity and use of equipment, and that there are certain risks associated with those activities and equipment, including risk of serious personal and/or bodily injury, death, or damage to or loss of property. You expressly and voluntarily assume all risk and, to the extent permitted by law, waive any and all actual or potential claims against Burlexercise arising from or related to your participation, instruction, classes, or activities, including the associated physical activity and equipment.

You have chosen to reside at the dwelling despite any inconveniences such as those disclosed herein or any other inconvenience, which may be associated with living in a mixed-use environment. You further agree: You are voluntarily assuming the risks of inconvenience and nuisance related to residing in a dwelling located in a mixed-use area. You agree that any inconvenience associated with the mixed-use area and/or the surrounding area, such as, but not limited to, those disclosed herein, will not be deemed to give you any offset to rent obligations, nor will they be the basis for a complaint against us for rent relief, constructive eviction, fitness and habitability, peaceful and quiet enjoyment, nuisance, or any other claim, right or remedy. We shall have no duty to evict any commercial business for any lights, sounds, vibrations, odors, etc. that may occur as a result of their commercial business. As such, you waive any and all claims against us that arise out of or are in any way related to lights, noises, sounds, vibrations, smoke, odors or any other inconveniences that may be caused by commercial business within the mixed-use area and/or their guests.

Each of the Parties fully understands that there is a risk that, after the execution of this Agreement, it may incur, suffer or sustain material injury, loss, damage, costs, attorneys' fees, expenses, or any of these, which are in some way caused by or connected with the Claims released by this Agreement, or which are unknown and unanticipated at the time this Agreement was executed, or which are not presently capable of being ascertained. Each of the Parties acknowledges that this Agreement has been negotiated and agreed upon in light of those understandings and hereby expressly assumes that risk and waives all rights it may have with respect to such claims.

Volunteers understand the potential hazards of this work as they have been described and are unaware of any existing medical conditions which may be adversely affected by this work. Volunteer also agrees to indemnify, hold harmless, and defend EBRPD, its officers, employees, and agents from all liability and claims from any injury, damage, or loss, or from any other costs which may arise out of or in connection with any claims for bodily injury or property damage which may result from services I perform or by my use of the City’s property and/or facilities in connection with the performance of said services. By signing below, I agree, promise, and covenant not to xxx, assert, or otherwise maintain or assert any claim against the EBRPD for any injury, death, illness, or disease, or damage arising from or connected with the services I have performed or may perform in the future.
Assumption of Risk/Waiver. Traveler is aware that travel such area as traveler is undertaking on the trip may involve inherent risks, some in remote areas of the world. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, Xxxx Vacations and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness,; known or unknown medical conditions, physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided. Traveler understands the description of these risks, including to risks due to COVID 19, is not complete and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the enjoyment and excitement of this trip, traveler is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness, and death. Traveler hereby accepts and assumes full responsibility for any and all risks of illness, injury or death and of the negligence of Xxxx Vacations and agrees to and shall hold harmless and fully release Xxxx Vacations, LLC its owners, members, agents, and assigns (together Xxxx Vacations) from any and all claims associated with the trip, including any claims of third party negligence and/or the negligence of Xxxx Vacations and traveler hereby covenant not to xxx Xxxx Vacations for any such claims or join any lawsuit or action that is suing Xxxx Vacations. This agreement also binds your heirs, legal representatives, and assigns. Attendee on behalf of him/her/their self and Minor understands and accepts that testing this recumbent and participating in cycling exposes Attendee and Minor to hazards and risk, and Attendee hereby assume for him/her/their self and Minor for all risk of injury, death or damage to property during test ride. This agreement will be governed by and interpreted in accordance of the laws of Multnomah County, Oregon. Any action must be brought in Multnomah County, Oregon. For any adjudication, the prevailing party will be entitled to the recovery of reasonable legals fees and court costs.
