JUNE 30, 2016 STATUTORY UPDATE: The GSA Order, OGP 4800.2I Eligibility to Use GSA Sources of Supply and Services, has been updated, signed, and posted to the GSA Directives Library. The impetus for issuance of this revised Order is the recent amendment to 48 U.S.C. § 1469e to, in relevant part, include the Commonwealth of Puerto Rico as an eligible user of GSA’s supply sources. The amendment was part of the Puerto Rico Oversight, Management, and Economic Stability Act (PROMESA), which was signed into law on June 30, 2016. The Commonwealth of Puerto Rico has access to the Agency’s sources of supply and services.

The Orange County Public Guardian as to Persons described in Subparagraph IV.G of this 20 Exhibit A. 21 7. The Public Health Services Function of the Orange County Health Care Agency as to 22 Persons described in Subparagraph IV.J of this Exhibit A. 23 8. The Orange County Fire Authority which dispatches medical transportation on behalf of 24 any authorized agency. 25 B. CONTRACTOR shall be responsible for ascertaining the identity of Persons requesting services 26 pursuant to the Contract and their position with the agencies listed above as being authorized signers 27 pursuant to the Authorized Signature List. COUNTY shall have no responsibility for the transportation 28 of Persons where agencies other than the above request such service. 29 C. CONTRACTOR shall be responsible for obtaining the Authorization for Medical 30 Transportation form filled out with all information from the service requester at the time of service. As long as consistent with 42 U.S.C. § 14132, stored DNA samples and DNA analyses can be disclosed only: (a) to criminal justice agencies for law enforcement identification purposes, which shall include (at the discretion of the Director) to assist the identification of human remains from mass disasters or to identify whether such remains are from those of a missing person, upon written or electronic request to the Director; (b) in judicial proceedings, if otherwise admissible by applicable statutes or rules; (c) for criminal defense purposes, to a defendant, who shall have access to samples and analyses performed in connection with the case in which such defendant is charged; and (d) if personally identifiable information is removed, for a population statistics database, for identification research and protocol development purposes, or for quality control purposes:

  • Authorized Agent Authorized Agent means the individual(s) appointed in writing by the Depositor (or by the beneficiary following the Depositor's death) authorized to perform the duties and responsibilities set forth in the Agreement on behalf of the Depositor.   • AUTHORIZED AGENTS On the Closing Date and from time to time thereafter, the Borrower shall deliver to the Administrative Agent an Officer’s Certificate setting forth the names of the employees and agents authorized to request Loans and Letters of Credit and to request a conversion/continuation of any Loan and containing a specimen signature of each such employee or agent. The employees and agents so authorized shall also be authorized to act for the Borrower in respect of all other matters relating to the Loan Documents. The Administrative Agent, the Arrangers, the Co-Agents, the Lenders and any Issuing Bank shall be entitled to rely conclusively on such employee’s or agent’s authority to request such Loan or Letter of Credit or such conversion/continuation until the Administrative Agent and the Arrangers receive written notice to the contrary. None of the Administrative Agent or the Arrangers shall have any duty to verify the authenticity of the signature appearing on any written Notice of Borrowing or Notice of Conversion/Continuation or any other document, and, with respect to an oral request for such a Loan or Letter of Credit or such conversion/continuation, the Administrative Agent and the Arrangers shall have no duty to verify the identity of any person representing himself or herself as one of the employees or agents authorized to make such request or otherwise to act on behalf of the Borrower. None of the Administrative Agent, the Arrangers or the Lenders shall incur any liability to the Borrower or any other Person in acting upon any telephonic or facsimile notice referred to above which the Administrative Agent or the Arrangers believes to have been given by a person duly authorized to act on behalf of the Borrower and the Borrower hereby indemnifies and holds harmless the Administrative Agent, each Arranger and each other Lender from any loss or expense the Administrative Agent, the Arrangers or the Lenders might incur in acting in good faith as provided in this Section 2.7.

  • Limited Agency (a) If the Access Holder is not also the Operator for a Path Usage, the Access Holder appoints each nominated Operator, as its agent for the following purposes: (i) providing inputs and agreeing to the final Daily Train Plan and the scheduling of Trains or changes to that plan or schedule for the Path Usages for which it is nominated by the Access Holder; (ii) the use of a Path Usage for which the Operator is nominated and scheduled to use under the Daily Train Plan including giving and receiving notices and instructions in relation to availability of Path Usages and the Services using those Path Usages in accordance with the Operator Sub-Agreement; (iii) agreeing to temporary changes to Train Paths, Path Usages or the Services in accordance with clauses 3.2(a) and 9 of the Operator Sub-Agreement; and (iv) the day to day operation of the Network for the Path Usages for which it has been nominated by the Access Holder as the Operator in accordance with clause 4 of this agreement and the Train Path Schedule, including communications with the Network Control Centre, providing Train manifests to ARTC and informing ARTC of any changes to the Services (including under clauses 5.4(k), (l) and (m) of the Operator Sub-Agreement), but the actual operation of Services on any Path Usage remains the responsibility of the Operator. (b) The Access Holder agrees: (i) that where an Operator is acting as its agent under clause 4.6(a): (A) the Access Holder is bound by, and releases ARTC from any Liability to the Access Holder relating to the acts or omissions of the Operator; (B) ARTC will deal directly with the Operator and is under no obligation to provide notices or deal with the Access Holder; and (C) to indemnify ARTC from any Claims made by the Operator arising from the Operator’s action or omissions as agent of the Access Holder, except to the extent such Claims arise from ARTC’s negligence or breach of this Agreement; (ii) to any changes to Services, Path Usages or Train Paths arising as a result of an Operator complying with its obligations under the Operator Sub-Agreement (including under clauses 5.4(c), 5.5, 8.1,
