Sources of Supply. In order to safeguard the integrity of PMBI, and to maintain the uniformity and quality of items associated with the Pradhan Mantri Bhartiya Janaushadhi Xxxxxx campaign, THE APPLICANT shall only purchase the medicines form Central Warehouse/Regional Warehouse/Authorized distributors of PMBI.
Sources of Supply. Seller shall endeavor to supply Coal from sources as mentioned in the Schedule II. In case the Seller is not in a position to supply the Scheduled Quantity (SQ) of Coal from such sources indicated in Schedule II, the Seller shall have the option to supply the balance quantity of Coal from alternate source, including Imported Coal. Further, in case of alternate sources, the Purchaser shall accept Coal directly from such alternate sources through Indian railway system and / or by alternate modes of transport depending upon operational flexibility and at such Delivery Point, as decided by the Seller. Additional cost due to supply through alternate source including the inland logistics cost of Imported Coal shall be borne by the Purchaser.
Sources of Supply. 3.3.1 The Seller shall endeavor to supply Coal from own sources as mentioned in Schedule I. In case the Seller is not in a position to supply the Scheduled Quantity (SQ) of Coal from such sources as indicated in Schedule I, the Seller shall have the option to supply the balance quantity of Coal through import which shall not, unless otherwise agreed between the parties, exceed 15% of the ACQ in the year 2012-13 ,13-14 and 14-15, 13% of ACQ in the year 2015-16 and 5% of the ACQ for the year 2016-17 and onwards. Seller may at its discretion, make such arrangement for supply of imported coal through CIL, and /or other enterprises. Accordingly, the Purchaser has to enter into a Side Agreement with CIL and/or Seller, as the case may be, in addition to this Agreement. The Side Agreement dealing with the terms and conditions for supply of Imported Coal would be an integral part of this Agreement.
3.3.2 For supply of coal through import as stated in clause 3.3.1 above, the Purchaser shall agreeto have back to back arrangements, if so required, with the Importing agency (ies) to be notified by the Seller/CILand deposit 100% of payable amount in advance. The commercial terms and conditions for such supply shall be regulated as per the Side Agreement.
3.3.3 The Seller may also offer coal from loading points/coal stocks to be lifted by the Purchaser by his/their own transport arrangement by road/road-cum-rail or any other mode up to 5 % of the ACQ. The provision shall however be applicable for supplies of coal under the Agreement from collieries of three coal producing subsidiaries of CIL viz. SECL, MCL and CCL. Further the provision shall continue till such time three major railway lines in these coal companies are constructed and made operational.
3.3.4 CIL reserves the right to transfer part of the ACQ from the Seller to another coal producing company (Subsidiary of CIL) based on the proposal received from the Seller, which would be binding on the Purchaser.
Sources of Supply. Delete “notify the Deputy Chief Engineer, Structures (DCES), with a copy to the Engineer, of” in the first line of the first paragraph and Substitute “submit to the Engineer”.
Sources of Supply. Only goods and services that meet FRANCHISOR’s then current Standards and are purchased from Approved Suppliers shall be used in the development, improvement or operation of the Franchised Restaurants. Such goods include the Approved Products including, without limitation, food and supplies, packaging and paper products, furnishings, fixtures, signage, equipment, uniforms and premiums. The decision to approve or disapprove proposed suppliers or distributors shall be made by FRANCHISOR in its sole discretion. FRANCHISOR may consider any factors it deems relevant in establishing specifications and standards and in approving suppliers and/or distributors and is not obligated to approve multiple suppliers and/or distributors of any good or service.
Sources of Supply. (a) The Company shall have the right to import materials and equipment not available in China in the qualities and quantities deemed necessary by the General Manager, except that items requiring import licenses shall be handled in accordance with the relevant import licensing regulations of China.
(b) Unless otherwise required by Chinese legal regulations, the Company shall have the right to appoint foreign architects, consultants, engineers and contractors to undertake relevant work when, in the opinion of the General Manager, there are no Chinese units or individuals qualified or available to undertake such work.

In case the Seller is not in a position to supply the Scheduled Quantity (SQ) of Coal from such sources as indicated in Schedule I, the Seller shall have the option to supply the balance quantity of Coal from alternate source. Further, in case of alternate sources, the Purchaser shall accept Coal directly from such alternate sources through Indian railway system and / or by alternate modes of transport depending upon operational flexibility and at such Delivery Point, as decided by the Seller, provided that such alternate delivery point for dispatch by rail/MGR shall be either Railway siding or wharf wall. Additional cost due to supply through alternate source shall be borne by the Purchaser.
3.3.2 In the event of shortfall of coal supplies from own sources, the Seller may consider supply of Imported Coal for which Seller shall inform the Purchaser three months in advance of such likely supplies and such supplies shall be made based on mutual consultation. In the event, the Purchaser declines to consider Seller’s offer on Imported Coal, it shall not be considered as Purchaser’s default under this Agreement.
3.3.3 In the event that the Seller is unable to supply the Contracted Quantity from

FCStone shall solicit sources of supply for Client as required to provide for Client’s requirements of Feedstock under prevailing market conditions, and for this purpose may deliver appropriate documents to Feedstock suppliers for execution and submission to Client. Client may, in its sole discretion, accept or reject any proposed supplier. If Client accepts a supplier it will notify FCStone that such supplier is authorized to enter into supply contracts with Client.
Sources of Supply. 4.3.1 The Seller shall endeavor to supply Coal from own sources as mentioned in Schedule I. In case the Seller is not in a position to supply the Scheduled Quantity (SQ) of Coal from such sources as indicated in Schedule I, the Seller shall have, at its sole discretion, the option to supply the balance quantity of Coal through import to be delivered at unload port at cost plus pricing including service charges of CIL. . In case of acceptance of imported coal by the Purchaser, the Purchaser shall execute a back-to-back agreement for supply with the Seller for such imported coal. In the event the quantity offered for imported coal is not accepted by the Purchaser, no penalty shall be applicable for the shortfall.

In order to safeguard the integrity of the MARKS, and to maintain the uniformity and quality of items associated with the SYSTEM, FRANCHISEE shall only purchase food, supplies, fixtures, equipment, furnishing, signs and other items for use in the SHOP in accordance with the following provisions.
