Availability of Disclosure Information. The Business Associate will maintain the Disclosure Information for at least 6 years following the date of the accountable disclosure to which the Disclosure Information relates (3 years for disclosures related to an Electronic Health Record, starting with the date specified by HHS). Availability of Disclosure Information. Unless otherwise provided under the HITECH Act, BUSINESS ASSOCIATE will maintain the Disclosure Information for at least 6 years following the date of the accountable disclosure to which the Disclosure Information relates. BUSINESS ASSOCIATE will report the Disclosure Information to COMPANY within 45 days following the accountable disclosure. In addition, where BUSINESS ASSOCIATE is contacted directly by an individual based on information provided to the individual by COMPANY and where so required by the HITECH Act and any accompanying regulations, BUSINESS ASSOCIATE shall make such Disclosure Information available directly to the individual.

To the extent the Business Associate is to carry out one or more of Covered Entity's obligation(s) under Subpart E of 45 CFR Part 164, comply with the requirements of Subpart E that apply to the covered entity in the performance of such obligation(s); and make its internal practices, books, and records available to the Secretary for purposes of determining compliance with the HIPAA Rules.
