Availability of Facilities. Upon reasonable notice by the Trust, the Transfer Agent shall make available during regular business hours such of its facilities and premises employed in connection with the performance of its duties under this Agreement for reasonable visitation by the Trust, or any person retained by the Trust as may be necessary for the Trust to evaluate the quality of the services performed by the Transfer Agent pursuant hereto;
Availability of Facilities. Customer understands that certain Services may not be available in all Spectrum service areas and Spectrum may decline to provide any requested Services. Spectrum’s ability to provide Services depends upon its ability to secure and retain, without unreasonable expense, suitable facilities, and rights to construct and maintain necessary facilities such as pole attachments and conduits to serve the Service Location. Spectrum may decline to accept or terminate a Service Order upon notice to Customer because of (a) the lack of transmission medium, transmission capacity or any other facilities or equipment, (b) the lack of available services from or interconnection with the services or facilities of other providers, or (c) any other cause beyond Spectrum’s control.
Availability of Facilities. The Company's obligation to furnish service or to continue to furnish service is dependent on its ability to obtain, retain, and maintain without unreasonable expense suitable rights and facilities, and to provide for the installation of those facilities required incident to the furnishing and maintenance of that service.
Availability of Facilities. (a) Service is offered and furnished subject to the availability of all necessary facilities, including those acquired by Syringa Networks from or through third parties. Syringa Networks may limit or allocate Service, if necessary, due to facilities availability, taking into account Syringa Networks’ then-current and projected capacity and the reasonable expectations of its existing and future customers.
(b) Except as expressly provided otherwise in an Exhibit or Service Order, Syringa Networks, following the provision of reasonable notice to Customer, may: (1) alter the methods, processes or suppliers by or through which it provides Service; (2) discontinue furnishing a feature or supporting an application associated with Service; (3) change the facilities used to provide Service; or (4) substitute comparable Service for that being furnished to Customer.
(c) Except as expressly provided otherwise in an Exhibit or Service Order, the facilities used to provide Service will be of Syringa Networks’ exclusive choosing. In no event will title to those facilities vest in Customer or any other individual or entity.
Availability of Facilities. The first priority of the church is to provide facilities for the extensive programming offered to and by the congregation of Bethlehem Lutheran Church Twin Cities. The facilities may be available for outside groups use Monday-Friday, 8:30AM until 8:30PM*, weekends are subject to availability. The facilities are not available for outside group use on holidays during the Lent or Advent seasons. Limited parking space must be taken into consideration when scheduling building use. *Exceptions to these times must be approved in writing prior to an event. An individual or group shall fall into one of the following categories

When Syringa Networks provides a portion of Service furnished by a third-party, the terms, conditions and pricing is done on an individual case basis (“ICB”) and will be subject to the requirements of the underlying service provider for that part of the Service it provides. Syringa Networks may limit or allocate Service, if necessary, due to facilities availability, taking into account Syringa Networks’ then-current and projected capacity and the reasonable expectations of its existing and future customers.

CenturyLink's obligation to furnish Service or to continue to furnish Service is dependent on its ability to obtain, retain and maintain suitable facilities and rights-of-way without unreasonable expense and to provide for the installation and testing of those facilities required incident to the furnishing and maintenance of that service.
Availability of Facilities. Service is offered and furnished subject to access to, and the availability of, all necessary facilities, including those acquired by the Company from other entities. Company may decline to accept a request for Service if it determines that facilities are not available.
Availability of Facilities. Service is offered and furnished subject to the availability of all necessary facilities, including those acquired by the Company from other entities. XO may decline to accept a request for Service if it determines that, based on its existing facilities at the time of the request and its current and forecasted need to provide other Services, it requires the available facilities for other Service needs. XO therefore may limit its provisioning of Service, if necessary, in order to manage its network and operations in an efficient manner and to meet the reasonable service expectations of its existing and future customers based on current and projected available facilities capacity. In addition, the Company may restrict or allocate Service among Customers, when necessary, due either to facilities shortages or causes beyond the Company’s control.
Availability of Facilities. The Sec- retary may make any eligible facility available for the purposes of the ARMS Initiative.
