Availability of Site. Xxxxxxxx-Xxxxxxxx shall be provided with direct access to the work site for the passage of trucks and materials and direct access to the roof. Xxxxxxxx-Xxxxxxxx shall not be required to begin work until underlying areas are ready and acceptable to receive Contractor’s work and sufficient areas of roof deck are available and free from dirt, water or debris to allow continuous full operation until job completion. The expense of water or debris removal and any extra trips by Xxxxxxxx-Xxxxxxxx to the job as a result of the job not being ready for roof application after Xxxxxxxx-Xxxxxxxx has been notified to proceed will be charged as an extra.

Availability of Site. Entity shall make the Site available to CCDPH to the maximum extent possible in connection with the Clinical Activities.

FRR shall not be required to begin work until underlying areas are ready and acceptable to receive FRR’s work and sufficient areas of roof deck are clear and available and free from snow, water or debris to allow for continuous full operation. The expense of any extra trips by FRR to and from the job as a result of the job not being ready for the Work after FRR has been notified to proceed will be charged as an extra.

Availability of Site. Host shall use its best efforts to ensure that the Site is publicly available to users a minimum of ninety nine and one-half percent (99.5%) of the time during any 24-hour period, except for (a) mutually agreed upon scheduled downtime for purposes of maintaining, updating and/or modifying the Site or otherwise upon the request of Client and (b) unforeseen disruptions to the Site or the Hosting Services caused by third-party data centers, internet service providers, telecommunications companies and other third parties beyond the control of Host.

  • Availability of Services CBT agrees not to discontinue or refuse to provide any service provided or required hereunder other than in accordance with the terms of this Agreement, or unless required by the Commission.

  • Availability of Service We will use reasonable efforts to make the Service available for your use on a continuous basis. The Service may be unavailable for short periods of time for regular or emergency system maintenance. We will endeavor to have our scheduled maintenance occur during non-peak hours. In addition, accessibility to the Service may be interrupted because of conditions beyond our control, including outages in Internet, cellular or other communications availability. We will use diligent efforts to re-establish the Services as promptly as possible. We do not promise the Service will always be available for your use. We may elect to discontinue this Service at any time. If we choose to discontinue the Service, we will provide you with reasonable notice in advance of that fact. We reserve the right at all times to take actions to protect our systems and information, including denial of access to users of the Service.

  • AVAILABILITY OF AGREEMENT The employer must ensure that copies of this Agreement and the NES are available to all employees to whom they apply, such as on a notice board which is conveniently located at or near the workplace or through electronic means, whichever makes them more accessible.

  • Availability of Records Consultant shall maintain the records supporting this billing for not less than three years following completion of the work under this Agreement.   • Availability of Books and Records Business Associate agrees to make its internal practices, books and records relating to the use and disclosure of PHI received from Covered Entity, or created or received, maintained or transmitted on behalf of Covered Entity, available to the Secretary of the U.S. Department of Health and Human Services for purposes of determining the Covered Entity and Business Associate's compliance with the HIPAA Standards. Business Associate promptly shall provide to Covered Entity a copy of any documentation that Business Associate provides to the Secretary.

  • Availability of Utilities All utility services necessary for the construction of the Improvements will be available prior to the commencement of construction, and all utility services necessary for the proper operation of the Improvements for their intended purposes are available at the Leased Premises or will be available at the Leased Premises prior to the Final Disbursement Date, at commercially comparable utility rates and hook-up charges for the vicinity, including water supply, storm and sanitary sewer facilities, gas, electricity and telephone facilities. Lessee shall furnish evidence of such availability of utilities from time to time at Lessor's request.
