BACKHOE. A 1-Year/1000-Hour Hour Warranty applies to all backhoe components but excludes normal wear and tear items MID-MOUNT MOWERS: A 1-Year/500-Hour Warranty applies to all mid-mount mowers. Normal wear and tear is excluded from this Warranty as are normal replaceable service items such as oils, lubricants, coolants, filters, and clutch and brake discs and linings as well as components which are subject to warranty extended by their respective manufacturers such as batteries, injector pumps, injectors and tyres. Additionally, belts, hoses, glass, light bulbs, upholstery, cab fittings and air-conditioning components are excluded. Normal deterioration of items such as plastic, rubber and exterior finish due to exposure or harmful substances is also excluded. To the fullest extent permitted by law, Mahindra shall not be liable for any consequential, special or indirect loss or damage and sole liability of Mahindra shall be limited to repair or replacement of defective parts as specified above and all other obligations or liabilities on the part of Mahindra are hereby excluded. It is a condition of this Warranty that the goods shall have been used in accordance with the procedures specified in the relevant Operator’s Manual. This Warranty shall not cover damage resulting from misapplication, abuse, misuse, failure to perform maintenance, negligence, fire or accidents. If the goods have been altered or repaired by someone other than an authorized Mahindra Dealer in a manner which, in the sole judgment of Mahindra, affects its performance, stability or reliability, then this Manufacturer’s Warranty shall be void. To obtain warranty service, the purchaser must report the defect in the goods to an authorized Mahindra Dealer within the applicable warranty term and where necessary present evidence of date of installation of the goods.   • DS3 Loop DS3 Loop is a two-point digital transmission path which provides for simultaneous two-way transmission of serial, bipolar, return-to-zero isochronous digital electrical signals at a transmission rate of 44.736 megabits per second (Mbps) that is dedicated to the use of the ordering CLEC in its provisioning of local exchange and associated exchange access services. It may provide transport for twenty-eight (28) DS1 channels, each of which provides the digital equivalent of twenty-four (24) analog voice grade channels.   • Television Equipment Recycling Program If this Contract is for the purchase or lease of covered television equipment, then Contractor certifies that it is compliance with Subchapter Z, Chapter 361 of the Texas Health and Safety Code related to the Television Equipment Recycling Program.

  • SUBLOOPS 45.1. Sprint will offer unbundled access to copper subloops and subloops for access to multiunit premises wiring. Sprint will consider all requests for access to subloops through the ICB process due to the wide variety of interconnections available and the lack of standards. A written response will be provided to CLEC covering the interconnection time intervals, prices and other information based on the ICB process as set forth in this Agreement.

  • TOOL STORAGE 1. A company shall provide on all construction jobs in towns and cities, and elsewhere where reasonably necessary and practicable (or if requested buy the employee), a suitable and secure waterproof lock-up solely for the purpose of storing employees’ tools, and on multi-storey and major projects the company shall provide, where possible, a suitable lock-up for employees’ tools within a reasonable distance of the work area of large groups of employees.

  • Dark Fiber 8.1 Subject to the conditions set forth in Section 1 of this Attachment and upon request by CBB, Verizon shall provide CBB with access to unbundled Dark Fiber Loops, Dark Fiber Sub-Loops and Dark Fiber IOF in accordance with, and subject to, the rates, terms and conditions provided in the Pricing Attachment and rates, terms and conditions of Verizon’s applicable Tariffs. Access to unbundled Dark Fiber Loops, Dark Fiber Sub-Loops and Dark Fiber IOF will be provided by Verizon only where existing facilities are available. Access to Dark Fiber Loops, Dark Fiber Sub-Loops and Dark Fiber IOF will be provided in accordance with, but only to the extent required by, Applicable Law. Dark Fiber Loops, Dark Fiber Sub-Loops and Dark Fiber IOF consist of Verizon optical transmission facilities without attached multiplexers, aggregation or other electronics. To the extent Verizon’s Dark Fiber Loops, Dark Fiber Sub-Loops and Dark Fiber IOF contain any lightwave repeaters (e.g., regenerators or optical amplifiers) installed thereon, Verizon shall not remove the same.   • Dewatering 4.7.1 Where a part of a site is affected by surface water following a period of rain, thus rendering some areas unsafe for productive work, consistent with the Employer’s obligations under the OH&S Act, all non- trades employees shall assist in ‘dewatering’ their own work site or area if it is so affected. Such work to be paid at single time rates. Productive work will continue in areas not so affected.

  • AT&T-22STATE and CLEC agree to provide the other Party with notification of any discovered errors in the record exchange process within ten (10) Business Days of the discovery.
