DEFECTIVE PARTS. Notwithstanding any other clause in these Conditions, all Parts supplied by the Supplier to the Purchaser are accompanied by an express product warranty which is valid for at least 12 months from the date the Part is first sold to a Retail Customer. The product warranty will be available if the Part is Defective. The product warranty on a Part provides that the Purchaser will be entitled to reimbursement of the following from the Supplier: (a) cost of the replacement Part; (b) handling charges equivalent to 25% of the cost of the replacement Part; and (c) actual labour costs associated with the diagnosis, removal and testing of the Defective Part and fitment of the replacement Part. If requested by the Supplier, the Purchaser must provide to the Supplier reasonable documentation in support of the replacement cost and labour costs claimed by the Purchaser. If User Error of the Part has occurred, the product warranty will not be available to the Purchaser but the Supplier must provide prompt notice of rejection to the Purchaser’s product warranty claim and detail the reasons for such rejection.

DEFECTIVE PARTS. Parts evidencing any Defect. Delay or Default: a delay or default to comply as defined in Clause 19.1.
DEFECTIVE PARTS. For purposes of this Service Agreement, the term "defective" when referring to Parts means a Part that is visually or operationally defective. Best Buy may return to Vendor all defective Parts for full credit or refund, to be applied or paid to Best Buy within thirty (30) days of Vendor's receipt of the defective Parts. Further, Vendor will promptly pay all shipping/handling costs associated with the defective Parts. Vendor warrants its Parts for the longer of the following alternatives: (1) a minimum of 90 days from the date the Warranty Services and/or Non-Warranty Services are complete or (2) until the expiration of the warranty on the Product.
DEFECTIVE PARTS. If faulty or suspect parts are detected, they must be picked out, labelled and separated. This task is to be carried out based on costs and capacities (carbovation gmbh, cus- tomer or third parties). Whoever is at fault must pay the costs. The possibility of defective parts mixing with good parts must be eliminated to ensure that only defect-free contract items are delivered. The supplier is only then entitled to deliver parts that deviate from specifications or design drawings if a design divergency note has been signed and approved.
DEFECTIVE PARTS. 3.1 Transportation The Purchaser shall bear the cost and risk of transport of defective parts to ECS’s facility, while ECS shall bear the cost and risk of transport of repaired or replacement parts to the destination stated in the Agreement. 3.2 Defective parts At ECS’s request, defective parts replaced in accordance with this Warranty shall be placed at the disposal of ECS.

The Buyer may require that the Seller deliver replacement goods at Seller’s expense on an expedited basis, or set off the purchase price of defective goods against current amounts owing to the Seller. The Buyer shall return the defective goods on freight collect basis.

DEFECTIVE PARTS. If defective or suspect parts are found, these must be sorted, labeled, and isolated. Actual implementation takes costs and capacities into account (Seuffer, customer or third parties). The party responsible for the cause will bear costs and expenses. Any mistaking or mixing with conforming parts must be avoided to assure that only conforming parts are delivered. The supplier is authorized to deliver parts deviating from specifications or drawing requirements only if a written deviation permit has been issued.
DEFECTIVE PARTS. RAMESES' shall have neither responsibility nor obligation whatsoever to replace defective part(s) of any hardware on which the Software is installed or operated by the End User;
