Beneficiary's Expenses. The Borrower shall pay all reasonable costs, charges and expenses, including reasonable attorneys' fees, unless covered by title insurance, which the Beneficiary may incur or expend in defending or enforcing the validity or priority of this Deed of Trust, or any term, covenant or condition hereof, or in collecting any sum secured hereby, or in protecting the security of the Beneficiary, or, if an Event of Default shall happen, in administering and performing its powers, privileges and duties hereunder. The Beneficiary may make advances or payments for such purposes but all advances or payments made by the Beneficiary for such purposes shall be repayable at once by the Borrower and shall bear interest at the rate provided in the Note from the date the same shall be become due and payable until the date paid, and any such sum or sums with interest as aforesaid shall become a part of the indebtedness secured hereby; No such advance or payment shall relieve the Borrower from any Event of Default hereunder.
Beneficiary's Expenses. The Trustor agrees to pay in full all expenses and reasonable attorneys’ fees of the Beneficiary or the Trustee which may have been or may be incurred by the Beneficiary or the Trustee in connection with the collection of the Obligations and the enforcement of any of Trustor’s obligations hereunder and under any documents executed in connection with the Obligations.
Beneficiary's Expenses. If Guarantor fails to pay the ---------------------- Liabilities after notice from Beneficiary of Borrower's failure to pay any Liabilities at maturity, and if Beneficiary obtains the services of an attorney for collection of amounts owing by Guarantor hereunder, or obtaining advice of counsel in respect of any of its rights under this Guaranty, or if suit is filed to enforce this Guaranty, or if proceedings are had in any bankruptcy, probate, receivership or other judicial proceedings for the establishment or collection of any amount owing by Guarantor hereunder, or if any amount owing by Guarantor hereunder is collected through such proceedings, Guarantor agrees to pay to Beneficiary its reasonable attorneys' fees.
Beneficiary's Expenses. If Beneficiary acquires any leasehold estate in the Property (whether as purchaser upon the foreclosure of the Deed of Trust, by deed in lieu of foreclosure, or under any provision of the Lease), all expenses incurred by Beneficiary in connection therewith, including without limitation all rental payments and other sums then due under the Lease, reasonable attorneys' fees, and attendant expenses, shall be due and payable by Tenant to Beneficiary immediately and without demand, and shall bear interest at the Default Rate.
Beneficiary's Expenses. Grantors agree to pay in full all reasonable costs and expenses, including attorneys’ fees, of the Beneficiary or the Trustee which may have been or may be incurred by the Beneficiary or the Trustee in connection with the collection of the Obligations and the enforcement of any of Grantors’ obligations hereunder and under any documents executed in connection with the Obligations.
Beneficiary's Expenses including Attorney's Fees. Regardless of the occurrence of a Default or Event of Default, Trustor agrees to pay to Beneficiary any and all advances, charges, costs and expenses, including the reasonable fees and expenses of counsel and any experts or agents, that Beneficiary may reasonable incur in connection with (i) the administration of this Deed of Trust, including any amendment thereto or any workout or restructuring, (ii) the creation, perfection or continuation of the lien of this Deed of Trust or protection of its priority or the Trust Estate, including the discharging of any prior or junior lien or adverse claim against the Trust Estate or any part thereof that is not permitted hereby or by the Loan Agreement, (iii) the custody, preservation or sale of, collection from, or other realization
Beneficiary's Expenses including Attorney's Fees. Regardless of the occurrence of a Default or Event of Default, Trustor agrees to pay to Beneficiary any and all advances, charges, costs and expenses, including the reasonable fees and expenses of counsel and any experts or agents, that Beneficiary may reasonable incur in connection with (i) the administration of this Deed of Trust, including any amendment thereto or any workout or restructuring, (ii) the creation, perfection or continuation of the lien of this Deed of Trust or protection of its priority or the Trust Estate, including the discharging of any prior or junior lien or adverse claim against the Trust Estate or any part thereof that is not permitted hereby or by the Loan Agreement, (iii) the custody, preservation or sale of, collection from, or other realization upon, any of the Trust Estate, (iv) the exercise or enforcement of any of the rights, powers or remedies of Beneficiary under this Deed of Trust or under Applicable Laws (including attorneys fees and expenses incurred by Beneficiary in connection with the operation, maintenance or foreclosure of the lien of this Deed of Trust) or any bankruptcy proceeding or (v) the failure by Trustor to perform or observe any of the provisions hereof. All such amounts and all other amounts payable hereunder shall be payable on demand, together with interest at the Default Rate.
