Common use of Bidding Clause in Contracts

Bidding. a. The Auctioneer reserves the right to regulate the bidding and shall have the sole right to refuse any bid or bids without giving any reason for such refusal. b. In the event that the auction comprises of more than one (1) property, the Auctioneer shall have the right to :- (i) Determine the order of sale; (ii) Offer the properties for sale either individually or collectively or in any combination or manner as determined by the Auctioneer; and/or (iii) Withdraw any of the properties from sale. c. Bidders may submit their bid at any of these stages of biddings. When system displays “No More Bids”, no further bids will be accepted by the Auctioneer. f. No bid shall be less than the last previous bid and each bid shall be increased by a minimum amount to be determined by the Auctioneer at the time the Property is put up for sale. g. The Auctioneer shall have the absolute right to withdraw the Property for sale at any time before the fall of the hammer and either after or without declaring the reserve price. h. In case of any dispute as to any bid, the Auctioneer may at his own option forthwith determine the dispute or put the Property up for sale again at the reserve price or at the last undisputed bid or withdraw the Property from the auction sale. The Auctioneer’s decision therein shall be final and conclusive. i. Subject to these Conditions of Sale and particularly to the reserve price, the highest bidder being so allowed or determined by the Auctioneer shall be the Purchaser upon the fall of hammer.

Any bid once entered by the registered online E-bidders shall be binding and the bid shall not be withdrawn or retracted in any manner whatsoever after the fall of the hammer. 3.8. Both the successful and unsuccessful bidders will be notified by the Auctioneer through the website and also via E-mail where further directions are given in order to conclude the sale of the auction property. 3.9. In the event of any dispute as to any biddispute, the decision of the Auctioneer may at his own option forthwith determine shall be final and binding on all bidders. 3.10. Unsuccessful E-bidders shall have the dispute or put deposit refunded free of interest to the Property up for sale again at same bank account from which the reserve price or at the last undisputed bid or withdraw the Property deposit transfer was made within two (2) working days from the auction saledate of auction. 3.11. Bidding. a. 7.1 Each Auction will have a set commencement and conclusion time and a minimum starting price. 7.2 The Auctioneer reserves Auction times will be as specified on the Website. 7.3 Bidding can occur via AutoBid or by placing an ordinary bid. 7.4 Bidding on an item indicates your intention to purchase that item. 7.5 As the bidder, you assert to Xxxxxxxx and shall be deemed by Xxxxxxxx to be the Principal and are personally liable for all obligations pursuant to the terms of this User Agreement. 7.6 Before placing a bid, you must read all details and descriptions of the product. However, Xxxxxxxx advises that this is a guide only and any descriptions and/or photographs depicted cannot be solely relied upon for the quality of the item. 7.7 Bidding is to be made on a per-item basis and may only be increased by the amount posted by Xxxxxxxx as the bid increment. 7.8 Bids cannot be cancelled once they are submitted. If using an Autobid, you must ensure that you have taken all reasonable care to ensure that it is set correctly, as once it is in place, it cannot be removed. 7.9 For Auctions where a Sales of Goods Act applies, subject to any limitation by law, you agree to exclude your right to regulate retract from a bid in an Auction pursuant to the bidding relevant Sales of Goods Act where the Auction took place. Xxxxxxxx, upon request and shall have the at its sole right discretion, may, in extraordinary circumstances, permit a bidder to refuse any retract a bid or bids without giving any reason for such refusalbefore an Auction closes. b. In 7.10 Upon the event conclusion of the Auction, if you hold the highest bidding price you will be notified by email. 7.11 Upon receiving notification that you are the auction comprises of more than one (1) property, winning bidder you accept the Auctioneer shall have Seller’s offer to purchase the right item and are obligated to purchase the item. You should thoroughly read the delivery/collection information. 7.12 You must not place a false bid aimed to mislead or manipulate. 7.13 Xxxxxxxx may close the Auction early if:- (ia) Determine the order of saleany false or misleading bidding is suspected; (iib) Offer the properties for sale either individually or collectively or in any combination or manner as determined by the Auctioneerproof of ownership of an item being sold cannot be proven; and/oror (iiic) Withdraw required or requested by any law enforcement agency. 7.14 The Auction will close at the end of the properties from salespecified time (‘Close Time’) if there are no successful bids or adjustments to your AutoBid during the 5 minutes immediately preceding the Close Time. If there is a successful bid or adjustment to your AutoBid during the 5 minutes immediately preceding the Close Time, then the Auction’s Close Time will be extended for 5 minutes (‘Bonus Time Period'). c. The Auctioneer reserves 7.15 You acknowledge and agree that any successful bid and/or adjustment to your AutoBid as submitted and made by you during a Bonus Time Period, shall reinstitute a further (and subsequent) Bonus Time Period. This will continue (i.e. consecutive Bonus Time Periods commencing) until such time as no further successful bids or adjustments to your AutoBid are made within the right to fix Bonus Time Period and that relevant Bonus Time Period shall end and the amount of bid hammer will fall, and the Auction will close. 7.16 Where a reserve price is applicable for an item at the time the Property is put up for sale. Subject to Auction, and there are no successful bids above the reserve price, the Auctioneer shall fix Auction will close with no sale. The bidder shall follow the bidding procedure as provided in the Auctioneer’s Online Terms and Conditions. e. Each bid will be called for 3 times, “First Calling, “Second Calling”, “Final Call”. Bidders may submit their bid at any of these stages of biddings. When system displays “No More Bids”, no further bids will be accepted by the Auctioneer. f. No bid shall be less than the last previous bid and each bid shall be increased by negotiate a minimum amount to be determined by the Auctioneer at the time the Property is put up for sale. g. The Auctioneer’s decision therein shall be final and conclusivesame time. i. Subject to these Conditions of Sale and particularly to the reserve price, the highest bidder being so allowed or determined by the Auctioneer shall be the Purchaser upon the fall of hammer.
