Shift Bidding. A. On or about February 15 and August 15 of each year, each employee shall be permitted to bid for the shift such employee prefers within the work unit of the Sheriff's Office to which such employee is assigned. Employees may express their preference for a specific start time available in a shift. Nothing in this section shall be construed to limit the right of the EMPLOYER to assign or reassign an employee to a specific start time. When a shift vacancy occurs between such bidding dates, such vacancy shall be filled based upon their bid preference as set forth in the most recent semi-annual bid. The new shift vacancy created by such process and one additional new shift vacancy shall be filled in the same manner. B. Employees who work in work units that use rotating shifts shall be required to rotate only between the two shifts that each employee specifies in the semi-annual bidding for shifts. C. The senior bidder for each shift is entitled to the shift bid for, if such bidder is qualified. Bidding must be for a position in the classification held by the bidder. D. If, as a result of a bidding for shifts, any shift would be staffed with personnel less than fifty percent of whom have at least two years of experience in the work unit, the EMPLOYER may reassign to such shift the most junior employees in the work unit who have the requisite two years of experience and make such other adjustment as may be necessary in order to retain such level of experience. E. The EMPLOYER may organize the Sheriff’s Office into such work units as it determines. "Work Units" are the principal divisions into which the Sheriff's Office is organized, some of which, as currently designated, are the work units known as Court Security, Jail, Radio, Patrol, Water Patrol, and Civil. The EMPLOYER may establish the hours of the shifts into which the work day is divided, if, in doing so, it complies with the provisions of this AGREEMENT specifying hours of work. The EMPLOYER may establish rotating shifts in such work units as it determines, but each period of rotation shall be at least two months. F. No employee shall be permitted to bid for shifts if such employee has less than twelve months of total employment in the Sheriff's Office, or if such employee has less than eight months of total service in the work unit to which such employee is assigned. Shift Bidding. A. No less than once each year, each shift (including days off) within each section of the Water Supply and Treatment Division (Xxxxx Xxxxx Water Treatment Plant, Sunol Water Treatment Plant and the Millbrae Corporation Yard) shall be open to bid. This provision shall not preclude the scheduling of additional shift bidding periods within particular bid units upon mutual agreement of Management and the Union. The annual shift bidding period required herein shall be integrated with transfer bidding in order to effect transfers and shift selections in a single integrated process at least once annually. Each location may have up to two shifts which shall be: Shift 1, 8:00 a.m. to 4:30 p.m., Shift 2, 3:30 p.m. to 12:00 a.m. or 4:00 p.m. to 12:30 a.m. The work week for both shifts at Water Supply and Treatment Division shall be Monday through Friday. B. Employees eligible to bid shall include all employees in the Water Supply and Treatment Division in class 7318, Electronic Maintenance Technician. C. At the time set by Management for the annual shift bidding period, the supervisor of each unit shall post for one (1) week shifts, and the number of employees in each classification to full such shifts, so that full-time employees described in paragraph B. above may submit their choices of shifts. Eligible employees who fail to submit timely bids, shall be assigned in the sole discretion of Management. D. Assignments shall become effective two weeks after the end of the posting period (or at the nearest commencement thereto of the next pay period) and shall be awarded in accordance with Water Supply and Treatment Division seniority in class above, except that Management may deny or delay bids that effect special projects or which require special skills or specific experience related to a specific job. E. Management shall retain the right between posting period to change an employee’s shift temporarily for training purposes or on account of unexpected operational demands. This period shall not exceed an aggregate of six (6) months for new hires and 120 days for existing 7318’s transferring in to the Water Supply and Treatment Division from other Public Utilities Commission Divisions or other Departments, provided the 120-day exclusion can be extended in the event the employee has yet to demonstrate the ability to satisfactorily perform duties. Shift Bidding. Each unit employee will be allowed to bid for the shift assignment of their choice; however the final selection for the shift assignment will be made by the Sheriff, or his designee, and be made in the Sheriff’s discretion. When making the final selection for the shift assignment, the Sheriff, or his designee, shall consider relevant factors, including, but not limited to, seniority, prior assignments to a particular shift, and the scheduling needs of the department. The provisions of this article shall not be subject to the grievance procedure contained in Article 13.

Shift Bidding a. Seniority: Shifts will be bid by seniority, except as provided below. There will be a Male Corrections Officers List and a Female Corrections Officers List for bidding purposes. Seniority of officers will be based on date of hire. If more than one officer was hired on the same date, the officer who placed higher on the Civil Service Eligibility List will be designated as the more senior officer. b. Each officer will bid in turn for his/her shift of choice for each shift rotation. In the shift bidding program, it is imperative that an officer makes his/her decision as rapidly as possible, so that the next officer may make his/her selection. Each officer signing up for next year’s schedule will be required to notify the next junior officer once she/he has completed his/her own shift bid. c. Shift bidding will begin on the 1st of December with an expected completion date of January 1st and implementation on the first Monday of the first full pay period in February.
