Common use of Bidding Clause in Contracts

Bidding. 1. At least five (5) days before the Bid Meeting, the Board shall post the list of available Route Packages which shall note the start time and end time of each route, the school(s) serviced, summary of the stops, the total estimated drive time for each Route and Route Package, and whether the Route or Route Package includes services to private and/or parochial schools. Nothing in this Article prevents the Board from starting certain Routes or Route Packages prior to the Bid Meeting based on the needs, calendars and schedules associated with such Routes or Route Packages, and such work shall be offered to bargaining unit members in descending order of Classification seniority for a temporary assignment until the completion of bidding provided such work is bargaining unit work as defined in this Article. 2. At least five (5) days before the start of classes each year, Bus Drivers shall attend the Bid Meeting to bid on available Route Packages and Routes. At the Bid Meeting, the Director of Transportation/Assistant Director of Transportation shall be present, and the Bus Drivers shall bid in descending order of Classification seniority on available Route Packages and Routes provided that each such Bus Driver has completed and successfully passed an annual physical examination in accordance with applicable state regulations and further that the combination of a Bus Driver’s selected Route Package and Route(s) (excluding Pre-Route and Post-Route Serving) may not exceed seven and one- half (7½) hours per day or thirty-seven and one-half (37½) hours per week. Such annual physical examinations shall be made available to bargaining unit members, at the Board’s cost, by the end of each fiscal year. 3. Any Routes and/or Route Packages not available for bidding at the Bid Meeting shall be subject to the bidding procedures herein when such Routes and/or Route Packages become available. 4. The Routes and Route Packages shall contain the estimated drive time for each Route or Route Package, the number of driving days, and the relevant school calendars, if available. Each Bus Driver shall have no more than fifteen (15) minutes to select an available Route and/or Route Package. 5. In the event that a Bus Driver has not completed the annual physical examination and in-service training in accord with applicable state regulations provided such in-service is scheduled prior to bidding, the Bus Driver will not be eligible to participate in bidding and/or driving for the Board and may be placed on an unpaid medical leave for a period not to exceed sixty (60) days. 6. If after the completion of the Bid Meeting, a Bus Driver becomes eligible for an assigned Route and/or Route Package, such Bus Driver shall be assigned an available Route and/or Route Package as determined appropriate by the Board or its designee. 7. Each Bus Driver shall be paid at the member’s applicable hourly rate for attending the Bid Meeting. Dry runs of Routes and/or Route Packages shall occur on the same day as the Bid Meeting, for which each Bus Driver shall be paid actual drive time not to exceed the estimated drive time for the member’s Route and/or Route Packages. 8. In addition, each Bus Driver shall be paid for the actual time (not to exceed 4.5 hours) spent completing the written “turn by turn” instructions for the member’s Route(s). Each Bus Driver shall submit the “turn by turn” instructions to the Director of Transportation/Assistant Director of Transportation 3 days before the start of the school year. 9. If a Bus Driver is unable to attend the Bid Meeting, the Bus Driver shall submit a written notice prior to the Bid Meeting to the Board or its designee that a proxy has been given to another Bus Driver who shall then be permitted to engage in the bidding procedures on behalf of the absent Bus Driver. If a Bus Driver is unable to attend the Bid Meeting and fails to submit a written proxy notice prior to the Bid Meeting to the Board or its designee, the Bus Driver will be assigned the remaining available Route(s) and/or Route Package after all the Bus Drivers present have bid or those submitting written proxy notices prior to their absence have completed their respective selection. 10. Buses and vans are not subject to any form of bidding and shall be assigned by the Board at its sole discretion.

Bidding. 1. At least five (5a) days before Potential Replacement Shippers must submit bids for released capacity which comport with the Bid Meeting, the Board shall post the list of available Route Packages which shall note the start time and end time of each route, the school(s) serviced, summary methodology of the stopsrelease notice stated in ten-thousandths of one dollar ($0.0000) per Dth one day per month for reservation charges, or in hundredths of one cent (0.00¢) per Dth for one-part volumetric rate bids or a percent of maximum, accompanied by a valid Bid for Capacity Release Form in the total estimated drive time form included on Transporter’s EBB. Bids submitted for each Route a permanent release must be submitted on a valid Request for Service as set forth in Section 3 of the General Terms and Route PackageConditions. For capacity release transactions of one (1) year or less in length that will take effect on or before one (1) year from the date on which Transporter is notified of the release, there will be no maximum price cap. Such bids (i) must be submitted electronically by potential Replacement Shippers to Transporter's EBB in the format established by Transporter for such bids on the EBB, (ii) must be displayed on the EBB when complete without revealing the identity of the bidder during the bidding period, and whether the Route or Route Package includes services to private and/or parochial schools. Nothing in this Article prevents the Board from starting certain Routes or Route Packages prior to the Bid Meeting based on the needs, calendars and schedules associated with such Routes or Route Packages, and such work shall be offered to bargaining unit members in descending order of Classification seniority for a temporary assignment until the completion of bidding provided such work is bargaining unit work as defined in this Article. 2. Such annual physical examinations Release Notice shall be made available to bargaining unit members, at the Board’s cost, by the end of each fiscal year. 3. Each Bus Driver shall submit the “turn by turn” instructions to the Director of Transportation/Assistant Director of Transportation 3 days before the start of the school year. 9. If a Bus Driver is unable to attend the Bid Meeting, the Bus Driver shall submit a written notice prior to the Bid Meeting to the Board or its designee that a proxy has been given to another Bus Driver who shall then be permitted to engage bid a quantity and a term of service different from those specified in the bidding procedures on behalf posted Release Notice; provided, however, that a Bidder shall not be permitted to bid a quantity or a term of service lower than any minimum quantity or term disclosed and posted by Releasor in the Release Notice. Bidders must accept all other conditions set forth in the Release Notice. (c) Bids shall be submitted by potential Replacement Shippers without bidders knowing the identities of other bidders. Bidders may submit multiple bids, each higher than the previous bid, during the posting period established pursuant to Section 14.3(e) above. (d) All bidders must (i) have pre-qualified under Transporter's creditworthiness standards, and (ii) where execution of an Assignment Agreement will be required within five days of its transmission by Transporter, have executed an Electronic Contracting Agreement with Transporter, as required by Section 3 (Requests for Service), Section 9 (Operating Conditions), and Section 5 (Service Agreement and Electronic Contracting), of the absent Bus DriverGeneral Terms and Conditions. (e) All bids for capacity release transactions more than one (1) year in length and all capacity release transactions one (1) year or less in length that will take effect more than one (1) year from the date on which Transporter is notified of the release shall neither exceed the maximum rates nor be less than the minimum rates permitted by the Commission for the released services. If Bids for capacity release transactions of one (1) year or less in length, that will take effect on or before one (1) year from the date on which Transporter is notified of the release, may exceed the maximum rates but shall not be less than the minimum rates permitted by the Commission for released services. Bids for capacity that are subject to maximum rates, and that are submitted at a Bus Driver one-part volumetric rate (which shall apply only to the reservation portion of the rate), shall not exceed a maximum rate calculated by converting the applicable maximum reservation charge into a volumetric charge at a 100% load factor plus the applicable commodity charges. (f) Bids are binding, other than contingent bids, until written or electronic notice of withdrawal is unable to attend received. Bids may be withdrawn before the Bid Meeting and fails to close of the bidding period. Any bidder that withdraws its bid for released capacity may not, within that same bidding period, submit a written proxy notice prior bid at a lower rate for any portion of that same capacity. (g) Where higher bids are received for capacity that Releasor proposes to the Bid Meeting release under a prepackaged arrangement that is subject to the Board competitive bidding (including prepackaged arrangements for 31 days or its designeeless for which Releasor requests competitive bidding), the Bus Driver will Replacement Shipper designated by Releasor (designated Replacement Shipper) shall be assigned the remaining available Route(s) and/or Route Package after all the Bus Drivers present have bid or those submitting written proxy notices prior to their absence have completed their respective selection. 10. Buses and vans are not subject to any form of bidding notified by Transporter and shall exercise its right to match the highest competing bid in accordance with the Capacity Release timeline under Section 14.1(c) above. For transactions one (1) year or less in length that will take effect on or before one (1) year from the date Transporter is notified of the release, a designated Replacement Shipper shall be assigned by required to match the Board at its sole discretionhighest competing bid, including bids that may be submitted in excess of the maximum rate. A Releasor shall not be able to specify an extension of the original pre-arranged match period without posting a new release.

Bidding. The parties recognize that numerous adjustments to routes are often necessary during the first weeks of the school year. Posted routes shall normally include the regular 180- day school year and intersession period assignments, if any. Daily bus routes shall be assigned by bargaining unit seniority using the bidding process. Seniority shall be by date of hire. The drivers with the greatest bargaining unit seniority shall select his/her route first and the process shall proceed in descending order until all routes are taken. The bidding process shall be seven (7) days prior to the start of the fall semester or first trimester. 18.4.1 The District shall notify all drivers at least seven (7) calendar days prior to the day of the bid. 18.4.2 The bid sheet shall be made available for review not later than noon of the workday prior to the bid day. The bid sheet shall contain all pertinent information on the route, and route number, and bus and shall also include bid time, bid close-out date and time, and the effective date of implementing the assignment. It is understood that changes may be made to the bid sheet after it has been made available for review, however, the District shall make an educated and good faith effort to assure the accuracy of the routes prior to sending the bid packets. Bidding shall not occur prior to 7:00 a.m. on the bid day. Drivers unable to attend the general bid shall authorize another regular driver to bid on his/her behalf. The proxy statement given to the supervisor prior to the bid shall be in writing, shall specify the name of the proxy, and shall give consent to accept any route awarded due to the proxy bid. After the annual bidding process has been completed, no driver will have his/her hours reduced during the year bid for unless the employee so requests, elects to rebid, or except via the layoff process. Absent drivers who fail to bid or submit a proxy must select from remaining routes in order to determine their minimum guaranteed hours for the year. Deleted Article XVIII placed in Contract Appendix as Agreed upon in Tentative Agreement signed by both parties November 11, 2004 and Board ratified on December 14, 2004 TRANSPORTATION - Page 3 Drivers on any leave status certified by their physician as eligible to return to work without restriction shall show proof of availability to accept assignment within thirty (30) calendar days prior to the effective date of any bid. Failure to provide such physician certification or failure to return to work without restriction at least ten (10) calendar days prior to the bid process will result in the driver's removal from the initial bid process, and the driver will be assigned to any regular route remaining at the conclusion of the initial bid process. In such case, the guaranteed assignment of 3.83 hours per day or 19.5 hours per week shall be used for benefit and pay calculation during the period of absence. Upon the release of the unit member by his/her physician to return to the route assigned under this section, the unit member shall work the assigned route. 18.4.3 Any regular run that is not on the bid board on the day of the bid shall be offered to the senior driver and then in descending order of seniority until accepted, not to exceed a total assignment of eight (8) hours. Any existing route permanently increased during the school year by forty-five (45) minutes or more shall be put up for bid. 18.4.4 Regular midday runs that do not continue from or continue into, the next run, shall be paid a minimum of one (1) hour. 18.4.5 When regular route vacancies occur during the year, and after regular bidding has been completed, the District will determine what vacant routes are available within ten (10) working days. At least A bid process will be offered for drivers, on a voluntary basis, to select a vacant assignment. Vacant routes will be posted for five (5) days before working days. Each Bus Driver shall submit the “turn by turn” instructions to the Director of Transportation/Assistant Director of Transportation 3 days before the start first day of the school year. 9. If a Bus Driver is unable to attend the Bid Meeting, the Bus Driver shall bid assignment may submit a written notice prior to the Bid Meeting to the Board or its designee that a proxy has been given to another Bus Driver who shall then be permitted to engage in the bidding procedures on behalf of the absent Bus Driver. If a Bus Driver is unable to attend the Bid Meeting and fails to submit a written proxy notice prior to the Bid Meeting to the Board or its designee, the Bus Driver will be assigned the remaining available Route(s) and/or Route Package after all the Bus Drivers present have bid or those submitting written proxy notices prior to their absence have completed their respective selectionbid. 10. Each Bus Driver shall submit the “turn by turn” instructions to the Director of Transportation/, the Assistant Director Superintendent of Transportation 3 days before Schools shall select the date for such meeting. The Assistant Superintendent’s decision shall be final. Two bid lists shall be developed prior to the start of the school year. One list will be for regular driving assignments and one list will be for extra driving assignments. The Association may review the lists before they are bid. Should an alternation to the route/run portion of the bid due to the circumstances out of the District’s control occur (child moves out of the District, etc.), the driver shall not be compensated for the loss of time. However, if an alteration is made due to such things as efficiency, parental complaints, etc., which result in the loss of time to that affected driver which cannot be otherwise be replaced in the original bid route/run, the affected driver shall be compensated for the same amount of time of the net loss. Unless a vacancy occurs, a bid shall be final and binding for the duration of the school year. 91. If The District may not unilaterally change an unit member’s bid run 2. A unit member may not request a Bus Driver change to their bid run unless there is unable to attend a mid-year transition as described in section B below. The first bidding period will begin twenty (20) calendar days before the last school day prior to Columbus Day recess. The next bidding period will begin thirty (30) days before the last school day prior to the Bid Meeting to December recess. The last bidding period will begin thirty (30) days before the Board or its designee that a proxy has been given to another Bus Driver who shall then be permitted to engage in the bidding procedures on behalf of the absent Bus Driver. If a Bus Driver is unable to attend the Bid Meeting and fails to submit a written proxy notice last school day prior to the Bid Meeting mid-winter recess. All unencumbered runs will be posted for no less than three (3) school days. Unit members interested in the position must submit notice of their interest to the Board Director of Transportation, or its his/her designee, during the Bus Driver posting period. The run shall be awarded on a seniority basis. Runs awarded in the three bidding periods will begin on the first school day after the designated recess period. Runs that become available after the mid-winter recess will be assigned filled by new contract drivers for the remaining remainder of the school year. Runs becoming available Route(sduring the first three periods (beginning of school to the last school day before Columbus Day recess, day after Columbus Day to the last school day before the December recess and the first day after December recess to the last school day before mid-winter recess) and/or Route Package after all the Bus Drivers present have bid or those submitting written proxy notices prior to their absence have completed their respective selectionwill be filled by substitute drivers until filled as per above. 10. Buses and vans are not subject to any form of bidding and shall be assigned by the Board at its sole discretion.

Bidding. 1. An employee may file a letter of intent at the Board offices if he/she is interested in a position in another classification. Job descriptions, including job qualifications, shall be available to interested employees and building reps at the board office. Hiring will consider: 1. Qualifications of the bargaining unit member. 2. If two (2) or more applicants are equally qualified, as determined by the Board, the unit member with the most district-wide seniority shall be awarded the position. 3. If no bargaining unit member is determined to be qualified by the Board for the position according to the qualifications as stated on the job descriptions then applicants outside the bargaining unit may be considered. C. If an employee is not selected through the above process, then the Superintendent will recommend that the Board fill the vacancy with a newly hired employee. D. Bus drivers will bid on routes within their area. Bus routes will be reviewed and revised each year. The Buckeye Hills shuttle routes will change each year and will be considered separately from regular routes. Buckeye Hills shuttle routes will be bid each year by seniority according to the following procedure: 1. The shuttle must be within the driver’s area. 2. Within five (5) days before miles of the start of classes each year, Bus Drivers shall attend the Bid Meeting to bid on available Route Packages and Routes. At the Bid Meeting, the Director of Transportation/Assistant Director of Transportation shall be present, and the Bus Drivers shall bid in descending order of Classification seniority on available Route Packages and Routes provided that each such Bus Driver has completed and successfully passed an annual physical examination in accordance with applicable state regulations and further that the combination of a Bus Driverdriver’s selected Route Package and Route(s) (excluding Prefirst pick-Route and Post-Route Serving) may not exceed seven and one- half (7½) hours per day or thirty-seven and one-half (37½) hours per week. Such annual physical examinations shall be made available to bargaining unit members, at the Board’s cost, by the end of each fiscal yearup. 3. Any Routes and/or Route Packages Driver must be able to return to their regular route on time. The parties agree that past practice shall not available for bidding at govern bus driving assignments. E. If a bargaining unit member is awarded a temporary position, such as a grant- funded position, and the Bid Meeting temporary position is eliminated or funding expires, the bargaining unit member will be awarded a position, and that award shall be subject to in accordance with the bidding procedures herein when such Routes and/or Route Packages become availableabove. 4F. If a bargaining unit member leaves the unit to accept a non-bargaining unit position, that person may apply for and return to the unit just as any other person outside the bargaining unit applicant could. The Routes Upon being reemployed in a bargaining unit position, the employee's classification and Route Packages district-wide seniority shall contain be restored, so long as the estimated return to the unit occurs with five (5) months of leaving the unit. G. Special Education (handicapped routes) may be bid after the Buckeye Hills routes with the district divided into two areas. H. Regular routes may be re-bid annually within the three areas of the district and routes may be adjusted to result in a cost savings for the district on drive time. All full time bus drivers will be guaranteed 6 hours of pay for drive time and 1 hour pay for each Route or Route Package, the number of driving days, cleaning and the relevant school calendars, if available. Each Bus Driver shall be paid at the member’s applicable hourly rate for attending the Bid Meeting. Dry runs of Routes and/or Route Packages shall occur on the same day as the Bid Meeting, for which each Bus Driver shall be paid actual drive time not to exceed the estimated drive time for the member’s Route and/or Route Packages. 8. In addition, each Bus Driver shall be paid for the actual time (not to exceed 4.5 hours) spent completing the written “turn by turn” instructions 8 hours per day for the member’s Route(s). Each Bus Driver shall submit the “turn by turn” instructions to the Director of Transportation/Assistant Director of Transportation 3 days before the start duration of the school yearcontract, unless the driver voluntarily changes his/her route. 9J. Management will be responsible for determining drive time by GPS. Buses and vans are not subject to any form of bidding and shall be assigned by the Board at its sole discretion.

Bidding. 1A. Bidding Routes Regular and extra driving assignments shall be determined by bidding. Each Bus Driver shall submit the “turn by turn” instructions to the Director of Transportation/, the Assistant Director of Transportation 3 days before Superintendent for Business shall select the date for such meeting. His decision shall be final. Two bid lists shall be developed prior to the start of the school year. One list will be for regular driving assignments and one list will be for extra driving assignments. The association may review the lists before they are bid. Unless a vacancy occurs, a bid shall be final and binding for the duration of the school year. In the event that a new/temporary run occurs, the run shall be posted. The run shall be awarded on a seniority basis for the available drivers bidding the run. The Director of Transportation shall determine a driver's availability. No driver may bid a combination of runs which exceed a total of 39.5 hours per week. No driver may be assigned a field/sport trip if the expected total weekly hours of their runs plus the field/sport trip(s) would exceed 39.5 hours in that particular week. When the work week is less than five (5) paid days, the above drivers will receive priority in assignments of field/sport trip runs. 9B. Mid-year Transitions The routes filled by drivers leaving the employ of the district during the school year, or those of drivers receiving new routes during a bidding period, will be placed up for bid twice each school year. If a Bus Driver is unable The first bidding period will begin thirty (30) calendar days before the last school day prior to attend Thanksgiving recess. The next bidding period will begin thirty (30) days before the Bid Meeting, the Bus Driver shall submit a written notice last school day prior to the Bid Meeting mid-winter recess. All unencumbered runs will be posted for no less than three (3) school days. Unit members interested in the position must submit notice of their interest to the Board Director of Transportation, or its designee that his/her designee, during the posting period. The run shall be awarded on a proxy has been given to another Bus Driver who shall then be permitted to engage seniority basis. Runs awarded in the two bidding procedures periods will begin on behalf the first school day after the designated recess period. Runs that become available after the mid-winter recess will be filled by new contract drivers for the remainder of the absent Bus Driverschool year. If a Bus Driver is unable to attend Runs becoming available during the Bid Meeting and fails to submit a written proxy notice prior first two periods (beginning of school to the Bid Meeting last school day before Thanksgiving recess and the first day after Thanksgiving recess to the Board or its designee, the Bus Driver last school day before mid-winter recess) will be assigned the remaining available Route(s) and/or Route Package after all the Bus Drivers present have bid or those submitting written proxy notices prior to their absence have completed their respective selectionfilled by substitute drivers until filled as per above. 10. Buses and vans are not subject to any form of bidding and shall be assigned by the Board at its sole discretion.

Bidding. (a) All employees except those with a disciplinary action pending or upheld at a level more severe than verbal or written warnings in the prior six (6) months covered by this Agreement may bid on a posted job. The job will be posted City wide for seven (7) days to find a qualified candidate to fill the position. AFSCME employees in the department with the open position will have three (3) days to submit a bid for priority consideration under subsection (b)(1) of this section. If any qualified AFSCME employees within the department submits a bid, Human Resources will discontinue the posting. No employee covered by this agreement with less than three (3) years seniority shall be allowed to bid on a job at a lower pay classification outside of his department (b) The City shall select a candidate for the open position per the following order of consideration: 1. Nothing in this Article prevents the Board from starting certain Routes or Route Packages prior to the Bid Meeting based on the needsminimum skills, calendars and schedules associated with such Routes or Route Packagesqualifications, and such work abilities. If skills, qualifications and abilities are basically equal, then departmental seniority shall be offered to bargaining unit members in descending order of Classification seniority for a temporary assignment until the completion of bidding provided such work is bargaining unit work as defined in this Articlecontrolling factor. 2. At least five (5) days before The bidder from within the start of classes each yearbargaining unit with the most skills, Bus Drivers shall attend the Bid Meeting to bid on available Route Packages qualifications, and Routes. At the Bid Meeting, the Director of Transportation/Assistant Director of Transportation abilities shall be presentselected as long as the member of the bargaining meets the minimum skills, qualifications, and abilities and criteria of the Bus Drivers shall bid in descending order of Classification job description. If skills, qualifications and abilities are basically equal, then bargaining unit seniority on available Route Packages and Routes provided that each such Bus Driver has completed and successfully passed an annual physical examination in accordance with applicable state regulations and further that the combination of a Bus Driver’s selected Route Package and Route(s) (excluding Pre-Route and Post-Route Serving) may not exceed seven and one- half (7½) hours per day or thirty-seven and one-half (37½) hours per week. Such annual physical examinations shall be made available to bargaining unit members, at the Board’s cost, by the end of each fiscal yearcontrolling factor. 3. Any Routes and/or Route Packages not available A bidder from outside the bargaining unit. Departments for bidding at purposes of this Article shall mean Cemetery, Street, Public Works and Utilities Operations, Public Works and Utilities Maintenance, Public Works and Utilities Network, Public Works, Central Garage, Public Buildings and Grounds Department, Communication Center, non-uniformed hourly employees of the Bid Meeting shall be subject to Police Department and non-sworn, non-exempt employees of the bidding procedures herein when such Routes and/or Route Packages become availablePolice Department, Airport, non-uniformed hourly employees of the Fire Department, and Building and Code Enforcement. 4. The Routes and Route Packages shall contain the estimated drive time for each Route or Route Package, the number of driving days, and the relevant school calendars, if available. Each Bus Driver shall have no more than fifteen (15c) minutes to select an available Route and/or Route Package. 5. In the event that the City determines there is no bidder qualified to fill the vacancy, it may hire a Bus Driver has not completed new employee for the annual physical examination and in-service training in accord with applicable state regulations provided such in-service is scheduled prior to biddingvacant position. (d) Upon selection, the Bus Driver successful bidding employee will not be eligible to participate in bidding and/or driving for the Board and may be placed on an unpaid medical leave in the open position for a trial period not to exceed sixty of ninety (6090) calendar days. 6. This would also apply between Ear Falls and Red Lake. On permanent layoffs bumping into other groups may commence on the Board first day of layoff, subject to the bumping clause above. Seniority will be set up and maintained on a departmental basis. One department will be comprised of all employees engaged in the production of forest products (xxxxx to roadside). Other departments, at Ear Falls Contracting, will be comprised of all employees engaged in the construction and maintenance of camp roads, landings and main roads, scarification and mechanical maintenance and repair. For the purpose of departmental layoffs, any employee posting to a new department will begin to accrue seniority in that department on the date of his transfer. Should such an employee be bumped or suffer a layoff he may be placed on bump to any position for which he is qualified within his original department, given he has the seniority. Should an unpaid medical leave for a period not to exceed sixty (60) days. 6. If employee forfeit his posting after the completion trial period, he may return to the junior position within his original department. The provisions of the Bid MeetingCollective Agreement will apply to all matters relating to Seniority that are not dealt with specifically by this document on Local Seniority and Departmental Seniority. In addition, each Bus Driver shall be paid for the actual time (not to exceed 4.5 hours) spent completing the written “turn by turn” instructions for the member’s Route(scause).
