Common use of Bidding Clause in Contracts

Bidding. 1. At least five (5) days before the Bid Meeting, the Board shall post the list of available Route Packages which shall note the start time and end time of each route, the school(s) serviced, summary of the stops, the total estimated drive time for each Route and Route Package, and whether the Route or Route Package includes services to private and/or parochial schools. Nothing in this Article prevents the Board from starting certain Routes or Route Packages prior to the Bid Meeting based on the needs, calendars and schedules associated with such Routes or Route Packages, and such work shall be offered to bargaining unit members in descending order of Classification seniority for a temporary assignment until the completion of bidding provided such work is bargaining unit work as defined in this Article. 2. At least five (5) days before the start of classes each year, Bus Drivers shall attend the Bid Meeting to bid on available Route Packages and Routes. At the Bid Meeting, the Director of Transportation/Assistant Director of Transportation shall be present, and the Bus Drivers shall bid in descending order of Classification seniority on available Route Packages and Routes provided that each such Bus Driver has completed and successfully passed an annual physical examination in accordance with applicable state regulations and further that the combination of a Bus Driver’s selected Route Package and Route(s) (excluding Pre-Route and Post-Route Serving) may not exceed seven and one- half (7½) hours per day or thirty-seven and one-half (37½) hours per week. Such annual physical examinations shall be made available to bargaining unit members, at the Board’s cost, by the end of each fiscal year. 3. Any Routes and/or Route Packages not available for bidding at the Bid Meeting shall be subject to the bidding procedures herein when such Routes and/or Route Packages become available. 4. The Routes and Route Packages shall contain the estimated drive time for each Route or Route Package, the number of driving days, and the relevant school calendars, if available. Each Bus Driver shall have no more than fifteen (15) minutes to select an available Route and/or Route Package. 5. In the event that a Bus Driver has not completed the annual physical examination and in-service training in accord with applicable state regulations provided such in-service is scheduled prior to bidding, the Bus Driver will not be eligible to participate in bidding and/or driving for the Board and may be placed on an unpaid medical leave for a period not to exceed sixty (60) days. 6. If after the completion of the Bid Meeting, a Bus Driver becomes eligible for an assigned Route and/or Route Package, such Bus Driver shall be assigned an available Route and/or Route Package as determined appropriate by the Board or its designee. 7. Each Bus Driver shall be paid at the member’s applicable hourly rate for attending the Bid Meeting. Dry runs of Routes and/or Route Packages shall occur on the same day as the Bid Meeting, for which each Bus Driver shall be paid actual drive time not to exceed the estimated drive time for the member’s Route and/or Route Packages. 8. In addition, each Bus Driver shall be paid for the actual time (not to exceed 4.5 hours) spent completing the written “turn by turn” instructions for the member’s Route(s). Each Bus Driver shall submit the “turn by turn” instructions to the Director of Transportation/Assistant Director of Transportation 3 days before the start of the school year. 9. If a Bus Driver is unable to attend the Bid Meeting, the Bus Driver shall submit a written notice prior to the Bid Meeting to the Board or its designee that a proxy has been given to another Bus Driver who shall then be permitted to engage in the bidding procedures on behalf of the absent Bus Driver. If a Bus Driver is unable to attend the Bid Meeting and fails to submit a written proxy notice prior to the Bid Meeting to the Board or its designee, the Bus Driver will be assigned the remaining available Route(s) and/or Route Package after all the Bus Drivers present have bid or those submitting written proxy notices prior to their absence have completed their respective selection. 10. Buses and vans are not subject to any form of bidding and shall be assigned by the Board at its sole discretion.

Bidding. 1. Such bids (i) must be submitted electronically by potential Replacement Shippers to Transporter's EBB in the format established by Transporter for such bids on the EBB, (ii) must be displayed on the EBB when complete without revealing the identity of the bidder during the bidding period, and whether the Route or Route Package includes services to private and/or parochial schools. Bidders may submit multiple bids, each higher than the previous bid, during the posting period established pursuant to Section 14.3(e) above. (d) All bidders must (i) have pre-qualified under Transporter's creditworthiness standards, and (ii) where execution of an Assignment Agreement will be required within five days of its transmission by Transporter, have executed an Electronic Contracting Agreement with Transporter, as required by Section 3 (Requests for Service), Section 9 (Operating Conditions), and Section 5 (Service Agreement and Electronic Contracting), of the absent Bus DriverGeneral Terms and Conditions. (e) All bids for capacity release transactions more than one (1) year in length and all capacity release transactions one (1) year or less in length that will take effect more than one (1) year from the date on which Transporter is notified of the release shall neither exceed the maximum rates nor be less than the minimum rates permitted by the Commission for the released services. If Bids for capacity release transactions of one (1) year or less in length, that will take effect on or before one (1) year from the date on which Transporter is notified of the release, may exceed the maximum rates but shall not be less than the minimum rates permitted by the Commission for released services. Bids for capacity that are subject to maximum rates, and that are submitted at a Bus Driver one-part volumetric rate (which shall apply only to the reservation portion of the rate), shall not exceed a maximum rate calculated by converting the applicable maximum reservation charge into a volumetric charge at a 100% load factor plus the applicable commodity charges. (f) Bids are binding, other than contingent bids, until written or electronic notice of withdrawal is unable to attend received. Bids may be withdrawn before the Bid Meeting and fails to close of the bidding period. Any bidder that withdraws its bid for released capacity may not, within that same bidding period, submit a written proxy notice prior bid at a lower rate for any portion of that same capacity. (g) Where higher bids are received for capacity that Releasor proposes to the Bid Meeting release under a prepackaged arrangement that is subject to the Board competitive bidding (including prepackaged arrangements for 31 days or its designeeless for which Releasor requests competitive bidding), the Bus Driver will Replacement Shipper designated by Releasor (designated Replacement Shipper) shall be assigned the remaining available Route(s) and/or Route Package after all the Bus Drivers present have bid or those submitting written proxy notices prior to their absence have completed their respective selection. 10. Buses and vans are not subject to any form of bidding notified by Transporter and shall exercise its right to match the highest competing bid in accordance with the Capacity Release timeline under Section 14.1(c) above. For transactions one (1) year or less in length that will take effect on or before one (1) year from the date Transporter is notified of the release, a designated Replacement Shipper shall be assigned by required to match the Board at its sole discretionhighest competing bid, including bids that may be submitted in excess of the maximum rate. Bidding. The parties recognize that numerous adjustments to routes are often necessary during the first weeks of the school year. Posted routes shall normally include the regular 180- day school year and intersession period assignments, if any. Daily bus routes shall be assigned by bargaining unit seniority using the bidding process. Seniority shall be by date of hire. The drivers with the greatest bargaining unit seniority shall select his/her route first and the process shall proceed in descending order until all routes are taken. The bidding process shall be seven (7) days prior to the start of the fall semester or first trimester. 18.4.1 The District shall notify all drivers at least seven (7) calendar days prior to the day of the bid. 18.4.2 The bid sheet shall be made available for review not later than noon of the workday prior to the bid day. The bid sheet shall contain all pertinent information on the route, and route number, and bus and shall also include bid time, bid close-out date and time, and the effective date of implementing the assignment. It is understood that changes may be made to the bid sheet after it has been made available for review, however, the District shall make an educated and good faith effort to assure the accuracy of the routes prior to sending the bid packets. Bidding shall not occur prior to 7:00 a.m. on the bid day. Drivers unable to attend the general bid shall authorize another regular driver to bid on his/her behalf. The proxy statement given to the supervisor prior to the bid shall be in writing, shall specify the name of the proxy, and shall give consent to accept any route awarded due to the proxy bid. After the annual bidding process has been completed, no driver will have his/her hours reduced during the year bid for unless the employee so requests, elects to rebid, or except via the layoff process. Absent drivers who fail to bid or submit a proxy must select from remaining routes in order to determine their minimum guaranteed hours for the year. If no bargaining unit member is determined to be qualified by the Board for the position according to the qualifications as stated on the job descriptions then applicants outside the bargaining unit may be considered. C. If an employee is not selected through the above process, then the Superintendent will recommend that the Board fill the vacancy with a newly hired employee. D. Bus drivers will bid on routes within their area. Bus routes will be reviewed and revised each year. The Buckeye Hills shuttle routes will change each year and will be considered separately from regular routes. Buckeye Hills shuttle routes will be bid each year by seniority according to the following procedure: 1. The shuttle must be within the driver’s area. 2. Within five (5) days before miles of the start of classes each year, Bus Drivers shall attend the Bid Meeting to bid on available Route Packages and Routes. At the Bid Meeting, the Director of Transportation/Assistant Director of Transportation shall be present, and the Bus Drivers shall bid in descending order of Classification seniority on available Route Packages and Routes provided that each such Bus Driver has completed and successfully passed an annual physical examination in accordance with applicable state regulations and further that the combination of a Bus Driverdriver’s selected Route Package and Route(s) (excluding Prefirst pick-Route and Post-Route Serving) may not exceed seven and one- half (7½) hours per day or thirty-seven and one-half (37½) hours per week. Such annual physical examinations shall be made available to bargaining unit members, at the Board’s cost, by the end of each fiscal yearup. 3.
