Boat Tours. Concessionaire shall provide Boat Tours and other similar tours with pre-approval of the Park Manager. Boat Tours shall be offered according to the following: 1). Number of vessels, types of vessels, shore points, routes, trip frequency, total number of trips per day and schedule shall be pre-approved, in writing, by the Park Manager. 2). Boat Tours shall be provided by means of safe, comfortable, well maintained, Coast Guard approved watercraft compatible with the launching and docking facilities provided at the Park. 3). Concessionaire shall schedule Boat Tours with the Cruise Ticket Booth as the point of sale. 4). Interpretive narratives shall be consistent with the Florida Park Service mission and shall be pre-approved, in writing, by the Park Manager. 5). Coast Guard certifications must be presented to the Department prior to commencing any operation under this Agreement. If the United States Coast Guard does not require an inspection from which to issue a Certificate of Inspection for the vessel, the Concessionaire shall present to the Department, prior to the execution of this Agreement, a current Florida Vessel Registration for the vessel. 6). The Concessionaire shall not change the vessels or the number of vessels without receiving pre-approval, in writing, from the Park Manager. Any vessels approved by the Park Manager for operations under this Agreement shall comply with the terms and conditions of this Agreement. 7). The Concessionaire shall obtain the Park Manager's written approval prior to placing vehicles, vessels and rental equipment in use. Approval of equipment will be based on public safety, resource protection, design and capacity of the vehicle or equipment, compatibility with other activities, compliance with the Americans with Disabilities Act, and aesthetic factors, such as compatible colors. 8). The Concessionaire and the vessel operator shall be liable for any damage to the Concessionaire’s vessels or adjacent vessels as a result of improper or negligent securing to the Park’s docks. It shall be the Concessionaire’s responsibility to protect the Concessionaire’s vessels during inclement weather. The Concessionaire shall be responsible for compliance with the Division’s Emergency Action Component (EAC). 9). The Concessionaire’s vehicles, trams, and equipment used in operations on the tram road are to be of the same color, with the company logo on each vehicle.   • Manager’s Use of the Services of Others The Manager may (at its cost except as contemplated by Paragraph 4 of this Agreement) employ, retain or otherwise avail itself of the services or facilities of other persons or organizations for the purpose of providing the Manager or the Corporation or Fund, as appropriate, with such statistical and other factual information, such advice regarding economic factors and trends, such advice as to occasional transactions in specific securities or such other information, advice or assistance as the Manager may deem necessary, appropriate or convenient for the discharge of its obligations hereunder or otherwise helpful to the Corporation or Fund, as appropriate, or in the discharge of Manager's overall responsibilities with respect to the other accounts which it serves as investment manager.
