Bonus Density Commitments. The Parties acknowledge and agree that the Maximum Residential Density of 2.6 ERUs per acre with a maximum of 4547 ERUs throughout the entire 1749.27 acres of the planned Firelight Community is only permitted under the City’s Land Use Ordinances (particularly 10-15C – MPDO Zone) by virtue of the MPDO Bonus Density program described in Section 10-15C-6. Specifically, Developer has committed to: i) dedicate to the City or reserve via an irrevocable conservation easement, open space in areas identified in Exhibit “F” (Firelight Residential Planning Area Map), ii) construct parks in those areas, and of a size, identified in Exhibit “E” (Firelight Parks Master Plan) and dedicate the same to the City such that the Firelight Community will have a level of service relating to parks in excess of that currently provided to other areas of the City, and iii) construct trails in those areas identified in Exhibit “D” (Firelight Trails Master Plan) such that the Firelight Community will have trails a level of service relating to trails in excess of that currently provided to other areas of the City (collectively “the Bonus Density Commitments”). So as to avoid the creation illegal subdivisions of land and unnecessary islands without access that might need to be modified in the future, and subject to subsectionSubsection 9(.e). below, the Bonus Density Commitments shall be performed by Developer when it commences Development Activity on the first phase of a residential subdivision or the first phase of a commercial site plan that directly abuts an area designated in the Firelight MPDO Plan as Open Space (Exhibit “F”), a park (Exhibit “E”) or a trail (Exhibit “D”).

  • Specific Commitments Investments in respect of a particular undertaking of one of the Contracting Parties with respect to nationals and companies of the other Contracting Party shall be governed, without prejudice to the provisions of this Agreement, the terms of that commitment to the extent that it is more favourable provisions than those laid down in this Agreement.

  • STAFF COMMITMENT 23. If this Settlement Agreement is accepted by the Hearing Panel, Staff will not initiate any proceeding under the By-laws of the MFDA against the Respondent in respect of the facts set out in Part IV and the contraventions described in Part V of this Settlement Agreement, subject to the provisions of Part IX below. Nothing in this Settlement Agreement precludes Staff from investigating or initiating proceedings in respect of any facts and contraventions that are not set out in Parts IV and V of this Settlement Agreement or in respect of conduct that occurred outside the specified date ranges of the facts and contraventions set out in Parts IV and V, whether known or unknown at the time of settlement. Furthermore, nothing in this Settlement Agreement shall relieve the Respondent from fulfilling any continuing regulatory obligations.

  • Revolving Loans The Borrower shall repay to the Lenders on the Maturity Date the aggregate principal amount of all Revolving Loans outstanding on such date.

  • Review of Commitments The Parties shall enter into successive rounds of negotiations, beginning not later than three years from the date of entry into force of this Agreement, and periodically thereafter as determined by the FTA Joint Committee, with a view to further improving specific commitments under this Chapter so as to progressively liberalise trade in services among the Parties.

  • Additional Commitments The Parties may negotiate commitments with respect to measures affecting trade in services not subject to scheduling under Article 106 (National Treatment) or Article 107 (Market Access), including those regarding qualifications, standards or licensing matters. Such commitments shall be inscribed in a Party's Schedule.

  • Employer Commitments It is agreed that the institution will make every reasonable attempt to minimize the impact of funding shortfalls and reductions on the work force. It is incumbent upon institutions to communicate effectively with their employees and the unions representing those employees as soon as the impact of any funding reduction or shortfall or profile change has been assessed. If a work force reduction is necessary, the Joint Labour Management Committee will canvas employees in a targeted area or other areas over a fourteen (14) day period, or such longer time as the Joint Labour Management Committee agrees, to find volunteer solutions that provide as many viable options as possible and minimize potential layoffs. Subject to any agreement that the Joint Labour Management Committee may make to extend the period of a canvass, such canvasses shall take place either: • prior to the issuance of lay-off notice to employees under the local agreement, or • by no later than fourteen (14) calendar days following the annual deadline for notice of non-renewal or layoff where a local provision provides for such a deadline, whichever date is later. The union shall be provided with a copy of each final plan for employee labour adjustment.

  • Annual Increments (a) For regular full-time Employees, a one-step increase within the salary range shall become effective as of the first day of April or the first day of October as the case may be. Where the anniversary date of an initial appointment falls between January 1 and June 30, the date of the increment increase will be April 1, and where between July 1 and December 31, the date of the increment increase will be October 1.

  • Reformulation Commitment As of the Effective Date, Xxx X’Xxxx shall not manufacture, import, distribute, sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1 above or carry the Proposition 65 warnings specified in Section 2.3 below.

  • Commitment of Current Revenues Only In the event that, during any term hereof, the Commissioners Court does not appropriate sufficient funds to meet the obligations of County under this Agreement, County may terminate this Agreement upon ninety (90) days written notice to Company. County agrees, however, to use reasonable efforts to secure funds necessary for the continued performance of this Agreement. The parties intend this provision to be a continuing right to terminate this Agreement at the expiration of each budget period of County. Agreements for the acquisition, including lease of real or personal property under Tex. Loc. Govt. Code §271.903: In the event that, during any term hereof, the Commissioner’s Court does not appropriate sufficient funds to meet the obligations of County under this Agreement, County may terminate this Agreement upon ninety (90) days written notice to Company, County agrees, however, to use a best efforts attempt to obtain and appropriate funds for payment of the Agreement. The parties intend this provision, if applicable, to be a continuing right to terminate this at the expiration of each budget period of County in accordance with Tex. Loc. Govt. Code §271.903 (Xxxxxx Supp. 1996).

  • MUTUAL COMMITMENTS ‌ 18 The parties to this Contract are mutually committed to the development of an efficient, cost 19 effective, integrated, person-centered, age specific recovery and resilience model approach to 20 the delivery of quality community behavioral health services. To that end, the parties are 21 mutually committed to maximizing the availability of resources to provide needed behavioral 22 health services in the Service Area, maximizing the portion of those resources used for the 23 provision of direct services and minimizing duplication of effort.
