Common use of Breaks between periods of work Clause in Contracts

Breaks between periods of work. (a) An Employee who works so much overtime between the termination of their previous rostered shift and the commencement of their next rostered shift, that they would not have a 10-hour break will be released after completion of such recall worked until they have had a 10-hour break. The Employee will not suffer any loss of pay for rostered ordinary hours occurring during such absence. (b) If, on the instructions of the Employer, an Employee resumes or continues work without having had a 10-hour break they will be paid at the rate of 200% (based on 1/38th of the weekly salary set out in Schedule 2B and Schedule 3B) until they are released from duty for such rest period. The Employee will then be entitled to be absent until they have had a 10-hour break. The Employee will not suffer any loss of pay for rostered ordinary hours occurring during such absence.
