Common use of BREAKS DURING OVERTIME Clause in Contracts

BREAKS DURING OVERTIME. When an employee works in excess of four (4) hours overtime contiguous to the regular shift or when an employee has been called out for emergency overtime which exceeds four (4) hours the Employer shall grant a one-half (1/2) hour paid lunch break. An additional one-half (1/2) hour paid break shall be granted for each additional four (4) hour period the employee works overtime.

SECTION 1. - When an employee works in excess of four (4) hours and eight (8) minutes overtime contiguous to the regular shift or when an employee has been called out for emergency overtime which exceeds four (4) hours and eight (8) minutes the Employer shall grant a one-half (1/2) hour paid lunch break. An additional one-half (1/2) hour paid break shall be granted for each additional four (4) hour-hour and eight (8) minute period the employee works overtime. If an employee works four (4) hours of overtime they shall be entitled to a fifteen (15) minute break.

Where the work performed did not allow the break described herein to be taken, the affected Employees will receive the equivalent pay for each additional four (4) hour period the employee works overtimemissed time break.
