Burstability Sample Clauses

Burstability. Customer acknowledges that Business service plans are burstable in nature and thus are not designed to maintain maximum burst rate over a sustained period of time. If Customer sustains usage in excess of the following thresholds, this may have a negative impact on additional Unwired customers. As a result, should Unwired notice sustained usage exceeding the below thresholds, Unwired reserves the right to request Customer to limit their average usage, or request that customer upgrade to a higher capacity service plan. Should the network be negatively impacted by sustained usage, Unwired reserves the right to arbitrarily and without notice limit the Customers maximum bandwidth in order to reduce network impact. Thresholds for sustained usage: • 18/4 plan is 1 mbps (128 KB/s) down / 1 mbps (128 KB/s) up • 26/7 plan is 2 mbps (256 KB/s) down / 2 mbps (256 KB/s) up • 34/10 plan is 3 mbps (384 KB/s) down / 3 mbps (384 KB/s) up

Burstability. (3)FlexSM Service - Premium and (3)FlexSM Service - Optimized each have limitations on the amount of usage allowed in excess of the applicable Virtual Circuit Committed Rate. Customer's usage of the (3)FlexSM Service for each class of service is limited as follows: (i) for (3)FlexSM Service - Premium, Customer's usage cannot burst above the Virtual Circuit Committed Rate; (ii) for (3)FlexSM Service - Optimized, Customer's usage cannot burst above two (2) times the Virtual Circuit Committed Rate, subject to the overall capacity available on the Level 3 network and the physical limitations of the Customer's port capacity; and (iii) for (3)FlexSM Service - Enhanced, there are no restrictions on Customer's usage bursting, subject to the overall capacity available on the Level 3 network and the physical limitations of the Customer's port capacity.
Burstability. The (3)PacketSM Service — Premium and (3)PacketSM Service — Optimized each have separate limitations for the amount of usage allowed in excess of the applicable Virtual Circuit Committed Rate. Customer’s usage of the (3)PacketSM Service for each class of service is limited as follows: (i) for (3)PacketSM Service — Premium, Customer’s usage cannot burst above the Virtual Circuit Committed Rate; (ii) for (3)PacketSM Service — Optimized, Customer’s usage cannot burst above two (2) times the Virtual Circuit Committed Rate; and (iii) for (3)PacketSM Service — Enhanced, there are no restrictions on Customer’s usage bursting, subject to the overall capacity available on the Level 3 network.

  • Compatibility 1. Any unresolved issue arising from a mutual agreement procedure case otherwise within the scope of the arbitration process provided for in this Article and Articles 25A to 25G shall not be submitted to arbitration if the issue falls within the scope of a case with respect to which an arbitration panel or similar body has previously been set up in accordance with a bilateral or multilateral convention that provides for mandatory binding arbitration of unresolved issues arising from a mutual agreement procedure case.

  • Safety Where an employee is prevented from working at the employee’s particular function as a result of unsafe conditions caused by the inclement weather, the employee may be transferred to other work in the employee’s classification on site, until the unsafe conditions are rectified. Where such alternative is not available and until the unsafe conditions are rectified, the employee shall remain on site. The employee shall be paid for such time without reduction of the employees’ inclement weather entitlement.

  • Electrical Provide drawings for the following systems:

  • Sprinkler System If there now is or shall be installed in the Building a "sprinkler system", and such system or any of its appliances shall be damaged or injured or not in proper working order by reason of any act or omission of Tenant, Tenant's agents, servants, employees, licensees or visitors, Tenant shall forthwith restore the same to good working condition at its own expense; and if the New York Board of Fire Underwriters or the New York Fire Insurance Rating Organization or any bureau, department or official of the state or city government, shall require or recommend that any changes, modifications, alterations or additional sprinkler heads or other equipment be made or supplied by reason of Tenant's business, or the location of the partitions, trade fixtures, or other contents of the Premises, Tenant shall, at Tenant's expense, promptly make and supply such changes, modifications, alterations, additional sprinkler heads or other equipment.

  • Quality All products will be new and unused. All products provided by the Contractor must meet all federal, state, and local standards for quality and safety requirements. Products not meeting the requirements of this section will be deemed unacceptable and returned to the Contractor for credit at no charge to the State.

  • Lighting A system of fixtures providing or controlling the light sources used on or near the airport or within the airport buildings. The field lighting includes all luminous signals, markers, floodlights, and illuminating devices used on or near the airport or to aid in the operation of aircraft landing at, taking off from, or taxiing on the airport surface.

  • Stability Testing Patheon may be requested to conduct stability testing on the Products in accordance with the protocols set out in the Specifications for the separate fees and during the time periods set out in Schedule C to a Product Agreement. Patheon will not make any changes to these testing protocols without prior written approval from Client. If a confirmed stability test failure occurs, Patheon will notify Client within one Business Day, after which Patheon and Client will jointly determine the proceedings and methods to be undertaken to investigate the cause of the failure, including which party will bear the cost of the investigation. Patheon will not be liable for these costs unless it has failed to perform the Manufacturing Services in accordance with the Specifications, cGMPs, and Applicable Laws. Patheon will give Client ail stability test data and results at Client’s request.

  • Monitoring In each case in which the Foreign Custody Manager maintains Foreign Assets with an Eligible Foreign Custodian selected by the Foreign Custody Manager, the Foreign Custody Manager shall establish a system to monitor (i) the appropriateness of maintaining the Foreign Assets with such Eligible Foreign Custodian and (ii) the contract governing the custody arrangements established by the Foreign Custody Manager with the Eligible Foreign Custodian. In the event the Foreign Custody Manager determines that the custody arrangements with an Eligible Foreign Custodian it has selected are no longer appropriate, the Foreign Custody Manager shall notify the Board in accordance with Section 3.2.5 hereunder.
