Common use of Call-In Language Clause in Contracts

Call-In Language. Where an employee is called in to work earlier than his/her regular or assigned starting time, then overtime rates for the work performed prior to the regular assigned starting time will only apply if the employee works in excess of eight (8) hours on that shift or the hours worked will exceed the hours of the basic work week. Time so worked in excess of eight (8) hours per day or forty (40) hours per week will be paid at the applicable overtime rate. At the time of the call-in, the Company will advise the employee as to whether the call-in will be straight time or overtime. When the Company calls in employees to work on their regular scheduled days off, they will be called in seniority order by department and who are capable of performing the work.
