Common use of Category B Clause in Contracts

Category B. (a) The regular work day shall be eight (8) hours and the regular work week five (5) consecutive days unless the work schedule is modified to provide for a flexible workday or work week, to a maximum of ten (10) hours per day exclusive of meal periods*, on the understanding that the biweekly hours of work set out in Article 62:01 are maintained. All hours worked beyond the scheduled daily or biweekly hours are subject to the overtime provisions set out in Article 63. (b) Based on the needs of students or other operational requirements; the Employer may assign flexible work assignments. The Employer shall assign hours in the following order: (i) Previously hired to work these hours; (ii) Employee volunteers; (iii) Assigned in reverse order of seniority. (c) Flexible work arrangements may be requested by the employee. Such requests shall not be unreasonably denied, subject to operational requirements. (d) Any change to the regular work day or work week arrangement shall be copied to the Union. A notice period of not less than ninety (90) days shall be provided in writing to the Union and the affected employee(s) for any change in the regular work day or work week arrangements. The notice period may be shortened or waived by mutual agreement between the Employer and the employee(s). The employee(s) has a right to Union representation. (e) Any variations to a work day where the hours of work exceed ten (10) hours per day shall only be instituted with the mutual consent of both parties. *Meal period inclusive: • Maintenance Engineer • Security Officer • Security Supervisor
