Changes in Price, Product, Development Plan and Marketing Methods. Buyer acknowledges that Seller may, in its sole discretion, and without notice to Buyer, change its pricing, product, development plan and marketing methods for other units in the Condominium, including, without limitation: (i) selling other units in the Condominium under terms and conditions which are more favorable than those offered to Buyer, (ii) offering incentives to buyers, (iii) selling units of the same type as the Unit at a lower price, or (iv) improving such other units with more or less expensive features and amenities. Buyer acknowledges that any of the foregoing events may adversely affect the value of the Property and that no agent or representative of Seller has made any promises, representations or warranties regarding the current or future value of the Property, future pricing adjustments or that income or profit can or will be realized from sale or rental of the Property.

Changes in Price, Product, Development Plan and Marketing Methods. Buyer acknowledges that Seller may, in its sole discretion, change its pricing, product, development plan and marketing methods for other Units in the Project including, without limitation, the following: Seller may elect to sell other Units in the Project, under terms and conditions which are more favorable than those offered to Buyer; Seller may elect to sell Units of the same type as the Property, but reduce the sales price for such lots and/or residences, or improve such lots and/or residences with more or less expensive features and amenities and/or Seller may elect to build residences at the Project with floor plans, elevations, sizes, amenities and/or other features that are materially different than the floor plans, elevations, sizes, amenities and/or other features of other residences already constructed by Seller at the Project or which Seller displayed to Buyer as indicating the future residences to be constructed at the Project, including without limitation in any approved plans and specifications, brochures, other marketing or advertising materials, feature lists, renderings or other similar documents provided by Seller, or on Seller’s behalf, to Buyer. Buyer acknowledges that any of the foregoing events may adversely affect the value of the Property. There shall be no modification of the Purchase Price due to any of these changes.

  • Product Changes Vocera shall have the right, in its absolute discretion, without liability to End User, to update to provide new functionality or otherwise change the design of any Product or to discontinue the manufacture or sale of any Product. Vocera shall notify End User at least 90 days prior to the delivery of any Product which incorporates a change that adversely affects form, fit or function (“Material Change”). Vocera shall also notify End User at least 90 days prior to the discontinuance of manufacture of any Product. Notification will be made as soon as reasonably practical for changes associated with regulatory or health and safety issues.

  • Additional Information for Product Development Projects Outcome of product development efforts, such copyrights and license agreements. • Units sold or projected to be sold in California and outside of California. • Total annual sales or projected annual sales (in dollars) of products developed under the Agreement. • Investment dollars/follow-on private funding as a result of Energy Commission funding. • Patent numbers and applications, along with dates and brief descriptions.  Additional Information for Product Demonstrations: • Outcome of demonstrations and status of technology. • Number of similar installations. • Jobs created/retained as a result of the Agreement.

  • For Product Development Projects and Project Demonstrations  Published documents, including date, title, and periodical name.  Estimated or actual energy and cost savings, and estimated statewide energy savings once market potential has been realized. Identify all assumptions used in the estimates.  Greenhouse gas and criteria emissions reductions.  Other non-energy benefits such as reliability, public safety, lower operational cost, environmental improvement, indoor environmental quality, and societal benefits.  Data on potential job creation, market potential, economic development, and increased state revenue as a result of the project.  A discussion of project product downloads from websites, and publications in technical journals.  A comparison of project expectations and performance. Discuss whether the goals and objectives of the Agreement have been met and what improvements are needed, if any.
