Claimant has actively participated in environment preserving efforts‌ 115 Respondent states in its counterclaim that Claimant is liable for the alleged Xxxx river contamination.154 Yet, Respondent fails to present any solid proof that Claimant is responsible for the environmental effects. What is more, it was Respondent’s duty to establish legal framework for environmental protection and be engaged in environment preserving efforts. However, only Claimant seemed to be actively participating in environment protection. 116 It must be stated that Xxxxxxxx’s operations are conducted in a way they amount to corporate socially responsible behaviour. Companies that behave ethically, contribute to economic development and improve quality of life for local communities, while tackling social and environmental issues as well, may be considered to act in a corporate socially responsible manner.155 This is especially important in countries with loose environmental and social regulations.156 Claimant with its actions not only strived to protect the environment, but in doing so, it created over 40 new jobs for the people of local communities. Claimant has employed more than 200 people in total for its lindoro excavating operations in Kronos. All of the employees are Respondent’s nationals.157 If we put those numbers into the perspective 20% of all of Claimant’s employees in Kronos are performing their duties in order to preserve the environment. Further, even in periods when there was no legal framework for environmental protection Claimant has nevertheless put the efforts into the environmental preservation where Respondent itself failed to act.
