Commencement Date of Lease. March 1, 2001 subject to the Landlord delivering Tenant possession of the Premises in shell condition four (4) months prior to Commencement Date, subject to extension for Force Majeure or Tenant Delay ("Delivery Date"). Shell condition means that all of the following have occurred: (i) substantial completion all of Landlord's Building Standard Improvements have been fully completed but for punch list items that do not materially or adversely interfere with or delay performance or completion of Initial Tenant Improvements (such capitalized terms are defined in the Construction Rider attached to this Lease); and (ii) if Tenant cannot obtain a building permit for the Initial Tenant Improvements because Landlord's Building Standard Improvements have not been completed or by reason of any outstanding permit or approval related to the Project or the Building ("Tenant Building Permit Condition"), then Shell condition shall not occur until Landlord has remedied the situation. The Commencement Date shall be delayed by the number of days (not to exceed 3 months) in which completion of the Initial Tenant Improvements is delayed due to Force Majeure and Landlord Delay, but in no event shall the Commencement Date be extended for Tenant Delays. The Commencement Date shall also be delayed based on the number of days in which issuance of a certificate of occupancy for the Premises following completion of the Initial Tenant Improvements is delayed on account of there not having been issued such necessary governmental approvals as are a condition precedent to Tenant receiving a certificate of occupancy for the Premises. Commencement Date of Lease. With reference to Paragraph 2.1 of the Agreement, the undersigned agree that the term of the Agreement commenced as of ____________________________, 1993.
Commencement Date of Lease. January 1, 2013, provided Tenant shall have access 180 days prior thereto for purposes of installation of fixtures, furniture, and equipment so long as Tenant has complied with the provisions of Section 14 hereof. Tenant has: (i) exercised its option to delay occupancy of the first floor of the Premises for a three (3) month period as allowed under Lease Paragraph 51, “Commencement Date, Lease Term and Basic Rent Schedule Amended in the Event Tenant Delays Occupancy on the First and/or Second Floor of the Premises” and (ii) hereby waived its option to delay occupancy of the second floor. Therefore, the Commencement Date for the first floor of the Premises shall be changed from July 1, 1994 to October 1, 1994 and the Commencement Date for the second floor of the Premises shall be February 1, 1995.
Commencement Date of Lease. Landlord delivered the Original Premises to Tenant on January 28, 2005 in the condition required by section 3.4 of the Original Lease. Notwithstanding anything to the contrary contained in the Lease, the Commencement Date (as defined in section 3.1 of the Lease) shall be February 1, 2005, and Tenant shall have the right to occupy the Original Premises without payment of any Base Rent from January 28, 2005 through January 31, 2005.
