Compliance with General Regulations. Subject to the terms, conditions and limitations of the Vested Property Rights Statute and except as otherwise provided in this Agreement, the establishment of vested property rights pursuant to this Agreement shall not preclude the application on a uniform and non-discriminatory basis of Town regulations of general applicability (including, but not limited to, building, fire, plumbing, electrical and mechanical codes, the Town Code, and other Town rules and regulations) or the application of state or federal regulations, as all of such regulations exist on the Effective Date or may be enacted or amended after the Effective Date. Owner does not waive its right to oppose the enactment or amendment of any such regulations.
Compliance with General Regulations. The establishment of Vested Development Rights and Vested Trips under this Agreement, shall not preclude the City’s application on a uniform and non- discriminatory basis of its regulations of general applicability (including, but not limited to, street and streetscape regulations, building, fire, plumbing, electrical and mechanical codes, the Denver Revised Municipal Code, and other City rules and regulations) or the application of state or federal regulations, as all of such regulations exist on the date of this Agreement or may be enacted or amended after the date of this Agreement, except for any newly enacted or amended City regulations not required by state or federal law that have the effect of materially and adversely altering, impairing, preventing, diminishing, imposing a moratorium on development, delaying or otherwise adversely affecting any of the Vested Development Rights and Vested Trips. Developer does not waive its right to oppose the enactment or amendment of any such regulations or to challenge the validity of such regulations through proper legal or political means. Nothing in this Agreement shall impair the City’s exercise of its police powers.
Compliance with General Regulations. The establishment of the vested rights under this Agreement shall not preclude the application of City ordinances and regulations of general applicability, except to the extent that such City ordinances and regulations have been expressly addressed herein. These ordinances and regulations include, but are not limited to, impact fees if the Project is included within an impact fee service area at the request of FCC, either existing or as they may be lawfully enacted in the future; construction and safety codes, such as building, fire, plumbing, engineering, electrical and mechanical codes; the City planning, zoning and land use policies; or other City, state, and Federal regulations as all of the foregoing exist on the date of this Agreement or may be enacted or amended after the date hereof, except as otherwise provided within this Agreement. FCC does not waive its rights to oppose adoption of any such proposed ordinances or regulations, not already in existence.

Nothing in this Agreement shall preclude the City’s application of its health and safety regulations, its regulations of general applicability (including, but not limited to, street and streetscape regulations, building, fire, plumbing, electrical and mechanical codes, the Denver Revised Municipal Code, and other City rules and regulations) or the application of state or federal regulations, as all of such regulations exist on the date of this Agreement or may be enacted or amended after the date of this Agreement. KRF does not waive its right to oppose the enactment or amendment of any such regulations or to challenge the validity of such regulations through proper means.
Compliance with General Regulations. Subject to the terms, conditions and limitations of the Vested Property Rights Statute except as this Agreement expressly provides otherwise, the establishment of vested property rights pursuant to this Agreement shall not preclude the application, on a uniform and non-discriminatory basis, of Centennial regulations of general applicability (including, but not limited to, building, fire, natural gas, housing, water, utilities, computer services, electrical, plumbing and wastewater treatment codes, the Centennial Municipal Code, and other Centennial rules and regulations) or the application of state or federal regulations, as all of such regulations exist on the Effective Date.
