Compliance with Xxxxxxxx “Anti-Kickback. Act. If the Agreement NOT TO EXCEED amount is in excess of Two Thousand & 00/100 Dollars ($2,000.00) and Services include construction, then the Vendor agrees as follows:
Compliance with Xxxxxxxx “Anti-Kickback. ACT The CONTRACTOR shall comply with the Xxxxxxxx Anti-Kickback Act (18 USC 874 and 40 USC 276c) as supplemented by Department of Labor regulations (29 CFR Part 3, “Contractors and Subcontractors on Public Buildings or Public Works Financed in Whole or in Part by Loans or Grants of the United States”). The Act provides that Contractor or subcontractor shall be prohibited from inducing, by any means, any person employed in the construction, completion, or repair of public facilities, to give up any part of the Attachment – X0 XXXXX XX XXXXXX SPECIAL CONDITIONS compensation to which they are otherwise entitled. SC-19 ENERGY EFFICIENCY The Contractor shall comply with the Energy Policy and Conservation Act (P.L. 94-163). Mandatory standards and policies relating to energy efficiency, contained in any applicable State Energy Conservation Plan, shall be utilized. SC-20 ARCHAEOLOGICAL SITES The CONTRACTOR should be aware that archaeological sites may be encountered during the construction of this project. If the CONTRACTOR encounters a potential archaeological site during construction, he shall immediately cease all operations in the area and contact the Project Manager and the State Historic Preservation Division. SC-21 WATER SYSTEM SPECIFICATIONS The “WATER SYSTEM STANDARDS” of the Department of Water Supply, County of Maui, dated 2002, and all subsequent amendments and additions, are by reference incorporated herein and made a part of these contract documents. The work embraced herein shall be performed by the Contractor in accordance with the “WATER SYSTEM STANDARDS” and the various sections of the State of Hawaii Special Conditions.
