Condition of Premises Upon Surrender. Except as otherwise provided in this Lease, Tenant shall, upon the expiration or earlier termination of the Term, surrender the Premises to Landlord in the same condition as on the date Tenant took possession, broom clean, except for reasonable wear and tear, damage caused by an event which is insured by property insurance maintained by Landlord pursuant to Section XIV.B.(1) below (subject to Tenant's obligations stated in the last sentence of Section X.B.), and condemnation (subject to Tenant's assignment to Landlord of the right to receive proceeds of condemnation for any fixtures or other property required to be surrendered to Landlord under this subsection D.). All appurtenances, fixtures, improvements, additions and other property attached to or installed in the Premises whether by Landlord or by or on behalf of Tenant, and whether at Landlord's expense or Tenant's expense, shall be and remain the property of Landlord unless Landlord specifically agrees or requires otherwise in writing (which removal, with respect to Alterations, shall be subject to Section XII. below). Any furnishings and personal property of Tenant located in the Premises, whether the property of Tenant or leased by Tenant (including the fixtures, improvements and other items agreed, in writing, by Landlord to belong to the Tenant as provided in the preceding sentence), shall be and remain the property of Tenant and shall be removed by Tenant at Tenant's sole cost and expense at the expiration of the Term. Tenant shall promptly repair any damage to the Premises or the Building resulting from such removal. Any of Tenant's property not removed from the Premises prior to the expiration of the Term shall, at Landlord's option, either become the property of Landlord or may be removed by Landlord and Tenant shall pay to Landlord the cost of such removal within ten (10) days after delivery of a xxxx therefor or Landlord, at its option, may deduct such amount from the Security Deposit. Any damage to the Premises, including any structural damage, resulting from Tenant's use or from the removal of Tenant's fixtures, furnishings and equipment, shall be repaired by Tenant at Tenant's expense.
Condition of Premises Upon Surrender. At all times during the Term, Tenant shall neither cause nor suffer any waste or injury to the Premises, and Tenant shall, at the expiration or other termination of the Term, surrender and deliver up the Premises in good order and condition as delivered to Tenant on the Commencement Date, ordinary wear and tear and, subject to the provisions of Section 9, damage by casualty, excepted.
Condition of Premises Upon Surrender. At the expiration of the Lease, Lessee will quit and surrender the Premises in as good state and condition as when received, reasonable wear and tear excepted. In the event Lessee alters, remodels and/or improves said Premises in accordance with its rights hereinbefore granted, it shall not, at the expiration of said Original Term or expiration of any Extended Term be required to restore the same to the condition said Premises were in when Lessee took possession, but Lessee may surrender the same in their altered, remodeled and/or improved condition without any further liability provided that the use and nature of the Premises has not been diminished.
Condition of Premises Upon Surrender. Customer shall make no alterations, improvements, additions or utility installations in, on, to or about the Premises without THE SWITCH’s prior written consent. Unless otherwise instructed in writing by THE SWITCH, Customer shall remove any such alterations, improvements, additions or utility installations consented to by THE SWITCH upon the expiration of the Term hereof and shall restore the Premises to their prior condition, reasonable wear and tear excepted. If THE SWITCH instructs Customer in writing not to remove them, all such alterations, improvements, additions and utility installations which Customer might make in, on, to or about the Premises shall become the property of THE SWITCH and remain upon and be surrendered within the Premises upon the expiration of the Term hereof. Except as otherwise provided in this Paragraph 3, Xxxxxxxx agrees to return the Premises to its previous state (e.g., set struck, overhead lighting returned to proper configuration, etc.) within twenty-four (24) hours of completion of taping. Any holding over by Customer after the expiration of the term hereof shall not be construed as a renewal of the Term hereof or give Customer any rights hereunder in or to the Premises or any part thereof.

Tenant shall promptly repair any damage to the Premises or the Building resulting from such removal. Any of Tenant’s property not removed from the Premises prior to the expiration of the Term shall be deemed abandoned, and, at Landlord’s option, either become the property of Landlord or may be removed by Landlord and Tenant shall pay to Landlord the cost of such removal within ten (10) days after delivery of a xxxx therefore.

All appurtenances, fixtures, improvements, additions and other property attached to or installed in the Premises whether by Landlord or by or on behalf of Tenant, and whether at Landlord's expense or Tenant's expense, shall be and remain the property of Landlord unless Landlord specifically(41) agrees otherwise in writing.(42) Any (43)furnishings(44) _____________________________ 40 , condemnation and casualty 41 states 42 Notwithstanding the foregoing, Landlord and Tenant hereby agree that (a) Tenant shall remove from the Data Center at the expiration of the Term (i) 50KW Caterpillar diesel generator/fuel tank, (ii) Liebert power distribution units, (iii) Liebert uninterruptible power systems with batteries, (vi) Damac communication racks/equipment and (v) command center in network operations room, (b) Tenant may, at Tenant's option, remove from the Data Center at the expiration of the Term (i) Liebert computer room air conditioners, (ii) security systems such as cameras and monitors, (iii) alarm equipment such as Liebert site scan and (iv) auto transfer switch, (c) Tenant must surrender with the Data Center (i) the raised access floor, (ii) the Data Center walls, ceiling and lighting, (iii) electrical conduits, wires, et cetera, (iv) mechanical piping and ductwork and (v) cable trays under the raised floor and above the T-bar ceiling, (d) Tenant may, with Landlord's prior written consent obtained at the expiration or earlier termination of the Term, which consent may be granted or withheld in Landlord's sole discretion, removed from the Data Center rooftop heat rejectors with pumps and accessories and/or electrical distribution panels, and (e) Tenant may surrender with the balance of the Premises telephone and data wiring which conforms to code and any Landlord's Work.
Condition of Premises Upon Surrender. When AMTRAK vacates the Premises at the expiration of the Term, AMTRAK shall leave the Premises in the same condition as when AMTRAK received possession, ordinary wear and tear, damage by fire or other casualty, or condemnation excepted and as may be altered, modified or improved in accordance with the terms of this Lease.
Condition of Premises Upon Surrender. At the expiration of the term of this Lease, Lessee will quit and surrender the Premises, in as good a condition and repair as existed on the Commencement Date of this Lease, reasonable wear and tear except Lessee shall in addition be obligated to remove all of its personal property and trade fixtures from the Premises, and, Lessee shall be obligated to repair all damage caused by such removal.
Condition of Premises Upon Surrender. Tenant agrees that it will keep the Demised Premises and fixtures therein in good order and condition and will, at the expiration or other termination of the term hereof, surrender and deliver up the same in like good order and condition as the Premises shall be at the commencement of the term of this Lease, ordinary wear and tear, and damage by the elements, fire, and other unavoidable casualty excepted.
Condition of Premises Upon Surrender. At the expiration of the Term Tenant will quit and surrender the Premises in good condition, reasonable wear and tear excepted, and remove all of its personal property and trade fixtures. In the event Tenant builds upon, alters, adds to or improves the Premises in accordance with its rights hereinbefore granted, it will not, at the expiration of said Term, be required to restore the same, but Tenant will surrender the same in its improved or altered condition without any further liability.
