Conditions Affecting Developer’s Work. The Developer shall be responsible for taking all steps reasonably necessary to ascertain the nature and location of the work to be performed under this DDA and to know the general conditions which can affect the work or the cost thereof. Any failure by the Developer to do so will not relieve Developer from responsibility for successfully performing the work without additional cost to the County. The County assumes no responsibility for any understanding or representations concerning the nature, location(s) or general conditions of the Property made by any of its officers or agents prior to the execution of this DDA. The requirements of this Section shall also be specifically imposed upon and apply to any subcontractors and subconsultants hired by Developer for purposes of complying with the obligations under this DDA.

Other than as expressly set forth herein, any failure by Developer to do so will not relieve Developer from responsibility for successfully performing the Work without additional cost to County above the GMP for such Work. County assumes no responsibility for any understanding nor makes representations concerning the nature, location(s) or general conditions of the Site made by any of County Contractors or third parties prior to the execution of this Agreement.

  • GENERAL WORKING CONDITIONS The District has empowered school communities to make decisions at the school level in return for accountability for results. To maximize the likelihood of success, each school must be permitted to implement programs that meet the needs of its students and community. Through a school-based decision-making process, each school will define the staff working conditions necessary for student success. School leadership teams will create and publish annual “school operational plans” which will outline working conditions of staff in the building. Such operational plans will be subject to the Superintendent’s review and approval.
