Unsafe Working Conditions. Employees shall be recognized by the Employer to have the competence to determine what constitutes unsafe working conditions within their discipline. No employee shall be disciplined for refusal to work in a situation which is deemed unsafe beyond the reasonable requirements of the employee's job.
Unsafe Working Conditions. The Superintendent shall be responsible for determining unsafe and hazardous environmental and teaching conditions under which paraeducators shall not be required to work. Such conditions shall be reported in writing to the principal/supervising administrator. If a resolution is not made, the assistant superintendent shall be notified in writing, with a final appeal to the superintendent.
Unsafe Working Conditions. An employee who is given an assignment that he or she reasonably believes will be detrimental to his or her health will immediately notify his or her supervisor. The employee will not be required to perform the alleged unsafe assignment, and will not receive discipline for refusing to do so, until the matter has been reviewed with the employee’s supervisor. If such a review does not resolve the matter, it will be referred to the University’s Environmental Health and Safety staff. At the employee’s request, a Union shop xxxxxxx will participate in any review conducted pursuant to this section.

Unsafe Working Conditions. No employee shall be disciplined for refusal to work on a job which, in the opinion of:
(a) a member of the Safety Committee; or
(b) a person designated by a safety committee, after an on-site inspection and following discussion with a representative of the Commission, does not meet the standards established pursuant to the Workers Compensation Act.
Unsafe Working Conditions. No employee shall be disciplined for refusal to work on a job which is unsafe. After an on-site inspection by the appropriate authority and discussion with the Employer and where the appropriate authority finds that a condition is unsafe or unhealthy for continued employment at that site, employees will not be assigned to that site until conditions have been corrected. Employees so affected will receive their regular rate of pay. The Employer will have the right to re-assign employees to other duties.
Unsafe Working Conditions. A. Management will annually advise employees, in writing, that they may report any apparent unsafe or unhealthy working conditions without fear of retaliation.
B. Management shall provide each employee information about the Safety Empowerment Authority and access to the Safety Empowerment Authority card within 30 days of entering upon duty, or upon request to their supervisor.
C. When an employee feels that he or she is subject to conditions so severe that even a short-term exposure to such conditions would be detrimental to health and safety, he or she should report the circumstances to the immediate supervisor. The supervisor shall inspect the work area or substance in question and analyze the situation to ensure that it is safe (or may be safely handled) before requiring the employee to carry out the work assignment. If any doubt regarding the safety of existing conditions is raised by the supervisor, an appraisal shall be obtained from the appropriate Management official before proceeding. Safety and health specialists may also be consulted by supervisors, employees, or managers, in these situations. The Union will receive, upon request, a copy of any documentation of the inspection or appraisal of the alleged unsafe working conditions.
1. Agency inspections will be conducted promptly in response to employee reports of imminent danger conditions, potentially serious conditions, and for other than serious safety and health conditions in accordance with 29 CFR 1960.28 (d)(3).
2. An inspection may not be necessary if, through normal Management action and with prompt notification to employees, and safety and health committees, the hazardous condition(s) identified can be abated immediately.
D. If the supervisor determines an unsafe or unhealthy circumstance exists and the supervisor cannot readily correct the hazard, the supervisor will take preventive action as specified in Section 10 above. The employee or group of employees who continue to believe that work is being required under conditions that are unsafe or unhealthy beyond the normal hazards inherent in the operations in question have the right to file a grievance. An employee or the Union may request an OSHA inspection at any time.
E. In the absence of immediate access to the supervisor, the employee may suspend his or her work whenever any environmental condition or combination of conditions (including, but not limited to, temperature, relative humidity, wind, precipitation, and air quality) becom...
Unsafe Working Conditions. (a) No Employee shall be disciplined for refusal to work on a job which is deemed unsafe by:
(1) a member of the Occupational Health and Safety Committee, or
(2) a person designated by an Occupational Health and Safety Committee, or
(3) the Safety Officer, after an on-site inspection and following discussion with a representative of the Employer, and where it does not meet the standards established pursuant to the Workers’ Compensation Act.
(b) Employees who are affected by the above provision shall be paid full salary and shall be assigned other duties.
Unsafe Working Conditions. A claim by an employee or group of employees that they are working under unsafe working conditions shall be investigated as quickly as possible by the Board. No employee will be required to work on an assignment which is unsafe. Such employee/s shall not be subject to disciplinary action and temporary alternative work at no loss in pay shall be provided until the matter is resolved.
Unsafe Working Conditions. When an employee has reasonable cause to believe that to carry out any work process or operate any equipment would create an undue hazard to the health or safety of any person, she/he has the right to refuse to proceed. An employee refusing to proceed shall immediately report the circumstances of the unsafe condition to her/his supervisor for investigation. If the employee is still dissatisfied, further investigations, in accordance with WorkSafe BC’s Occupational Health & Safety Regulation (OHSR) shall be undertaken. No employee shall be subject to disciplinary action provided she/he has acted in compliance with this clause, OHSR or an order made by an officer of the Board. When an employee refuses to carry out any work procedure or operate any equipment under this Article, no other employee may be asked to perform the work without being advised that a potential safety concern has been raised. If the operation of a department is suspended due to the application of this Article, employees may be temporarily reassigned outside the department without loss of pay, provided no other employee is displaced as a result. The employees shall be returned to their original positions when the department resumes operation.
