Conditions to the Grant. (a) Any Disbursement to be made by Ontario pursuant to the Agreement is subject to there being an appropriation by the Legislative Assembly for the Fiscal Year in which the Disbursement is to be made. If Ontario does not receive the necessary appropriation, Ontario shall not be obligated to make any such payment. As a con- sequence, Ontario may terminate the Agreement immediately upon giving notice to the Recipient and may demand repayment of any portion of the Grant that has not been used or committed by the Recipient to defray Eligible Project Expendi- tures.
Conditions to the Grant. (a) BACD has received funds from Ontario (less any holdback) under the Ontario Agreement. If BACD does not receive the necessary grant or subsequent holdback from Ontario, BACD shall not be obligated to make any such payment.
Conditions to the Grant. As a condition to receiving a Grant payment, Accelr8 shall have satisfied (or caused to be satisfied) the conditions and requirements specifically set forth below in this Section 3.1, provided, however, that the condition set forth in Section 3.1.1(i) below shall apply only to the Milestone One Grant Payment and shall not apply to any other Milestone payments or to Accelr8’s eligibility for any Arizona tax credits except as may be separately required by applicable statute under such tax credit programs:
