Conflicts in Documentation. This Agreement, including the Exhibits hereto shall be taken as mutually explanatory. If either Party becomes aware of an express conflict between the provisions of this Agreement or any Exhibit hereto, such Party shall promptly Notify the other Party of such conflict. In the event of a conflict between any provision within Articles 1 through 31 of this Agreement and an Exhibit, the provisions of Articles 1 through 31 of this Agreement shall take precedence over Exhibits A and H, which shall in turn take precedence over the remaining Exhibits.
Conflicts in Documentation. This Agreement constitutes the entire understanding between the parties regarding the manufacture of the Products. In case of any conflict between this Agreement and any prior agreements including but not limited to Distribution Agreement or other documents on the same subject, the order of precedence shall be: (1) this Agreement; (2) the schedules; (3) purchase orders; and (4) other documents.
Conflicts in Documentation. 2.1 Subject to sub clause 17.5, in the event of any conflict between these Terms and either:
a) the Governing Instrument;
b) any Additional Terms;
c) the Engagement Letter;
d) any relevant Services Agreement;
e) the Application Form;
f) the Terms; the documents shall prevail in the order of (a), (b), (c), (d), (e) and (f).
Conflicts in Documentation. If a conflict arises between this Agreement (other than Article III hereof) and any Appendices or further documentation, this Agreement shall govern and prevail, and the conflicting terms and conditions of any such documents shall be deemed deleted and shall not be binding upon either Party.
Conflicts in Documentation. In the event of a conflict or variation between any provision within the Transaction Documents and the PPM, the Transaction Documents shall take precedence over the PPM.
Conflicts in Documentation. In case of any conflicts between this AGREEMENT and any prior agreements on the same subject correspondence, and other documents during the term of this AGREEMENT, this AGREEMENT shall govern and prevail, and the conflicting terms and conditions of any such documents shall be deemed deleted and shall not be binding upon either PARTY. In the event the provisions of this AGREEMENT conflict with provisions of the Appendices, this AGREEMENT shall prevail unless otherwise specifically agreed upon.
Conflicts in Documentation. If there is an express conflict between the provisions contained within the body of this Contract and the provisions of any Exhibit hereto, then the body of this Contractor shall take precedence, except with respect to technical specifications and requirements pertaining to the design, engineering, operation or testing of the Power Plant, with respect to which the conflicting Exhibit shall take precedence.
Conflicts in Documentation. It is the intent of the Parties that each of the covenants, specifications and other obligations required to be performed by the Parties hereunder is an independent covenant, specification or obligation and that the Parties shall be required to perform all such covenants, specifications and obligations. The various parts of this Contract are intended to supplement and to be mutually explanatory of each other. Any Work required under one part and not another part shall be performed as if it had been set forth in all applicable parts of this Contract. Contractor has reviewed this Contract (including all of the Exhibits) and represents that it is able to perform all of its covenants, specifications and obligations. Notwithstanding the foregoing, in the event of any inconsistencies between this Contract and the other Contract documents, the following order of precedence in the interpretation hereof or resolution of such conflict hereunder shall prevail:
(a) Amendments, addenda or other modifications to this Contract (including Change in Work Forms) duly signed and issued after the signing of this Contract, with those of a later date having precedence over those of an earlier date;
(b) Articles 1 through 34 of this Contract;
(c) Exhibit A, then all the other Exhibits hereto; and
(d) Drawings and Specifications produced and delivered pursuant hereto (in respect of which, precedence shall be given to Drawings and Specifications of a larger scale over those of smaller, figured dimensions on the drawings shall control over scaled dimensions, and noted materials shall control over un-dimensioned graphic indications). Where an irreconcilable conflict exists among Applicable Laws, this Contract, the Drawings and Specifications, the earliest item mentioned in this sentence involving a conflict shall control over any later mentioned item or items subject to such conflict. Notwithstanding the foregoing provisions of this Section 2.3, if a conflict exists within or between parts of this Contract, or between this Contract and Applicable Laws, or among Applicable Laws themselves, the more stringent or higher quality requirements shall control. All obligations imposed on Contractor and each Subcontractor under Applicable Laws or Applicable Permits and not expressly imposed or addressed in this Contract shall be in addition to and supplement the obligations imposed on Contractor under this Contract, and shall not be construed to create an “irreconcilable conflict.” Where a co...

If there is an express conflict between the provisions of this Agreement or any Exhibit hereto, Contractor shall immediately notify Owner of such conflict. Owner, in its reasonable discretion, shall choose which conflicting provision it requires Contractor to follow. In the event of a conflict between any provision within Articles 1 through 33 of this Agreement and an Exhibit, the provisions of Articles 1 through 33 of this Agreement shall take precedence over any of the Exhibits. In the event of a conflict between the Exhibits and any Submittals, the Exhibits shall take precedence over any Submittals.
Conflicts in Documentation. In the event that a conflict arises -------------------------- between this Agreement and any work order or purchase order related to the Joint Development Project, this Agreement shall govern and prevail, and the conflicting terms and conditions of any such documents shall be deemed deleted, and shall not be binding upon either party. In connection with the terms of Articles 1 through 18. of this Agreement and attached Exhibits A through J, the terms of such Exhibits shall be construed in a manner that is consistent with the terms of such Articles; and in the event of any conflict between such Articles and Exhibits, the terms of Articles 1. through 18. shall prevail.
