Consultants’ Reports. The Independent Engineer Report, the Environmental Report and the Insurance Report, in each case, in form and substance reasonably satisfactory to Administrative Agent and permitting reliance thereon by Administrative Agent and the Lenders, shall have been delivered to Administrative Agent.
Consultants’ Reports. Each Financing Party shall have received an electronic copy of a report of each Independent Consultant as to the matters set forth opposite such report on Appendix I.

The Administrative Agent shall have received an Amended and Restated Professional Services Agreement entered into between the Independent Engineer, the Administrative Agent, the Borrower and Bloom, in form and substance satisfactory to the Administrative Agent.

The Administrative Agent shall have received a reasonably satisfactory report of the Independent Engineer discussing such matters as to the Incremental Projects as the Lenders may require, including (i) technical aspects of the Incremental Projects; (ii) all relevant Incremental ESAs; (iii) operating budget of the Incremental Projects; (iv) maintenance program in relation to the Incremental Projects; and (v) pro forma revenues and operating expenses with respect to the Incremental Projects, and dated no earlier than fifteen (15) days prior to the Incremental Facility Closing Date.

The Owner Participant, the Owner Lessor, the Lease Indenture Trustee, the Bondholder Trustee and the Lender shall have received the Power Market Consultant's report and the final report prepared by the Engineering Consultant, which reports shall be in form and substance satisfactory to the Owner Participant. The Owner Participant, the Bondholder Trustee and the Lender shall have received the Phase I and Phase II environmental reports prepared in 1999 with respect to the Facility Site from the Environmental Consultants, which reports shall be satisfactory to the Owner Participant, the Bondholder Trustee and the Lender. Xxxxx City shall cause the Environmental Consultants to deliver at the same time a reliance letter addressed to the Owner Lessor and the Owner Participant allowing them to rely on such reports as if addressed to each of them.

Consultants’ Reports. (a) In this Subclause, "Consultants' Reports" means any report prepared by PricewaterhouseCoopers prior to the date of this Agreement and referred to in Part I of Schedule 2 (Conditions precedent documents).
Consultants’ Reports. A copy of each consultant report submitted by a consultant to any City official or to any officer, employee, agent or representative of a City department, agency, commission or body or to any corporation, association or entity whose expenses are paid in whole or in part from the City treasury shall be furnished to the Commissioner of the department to which such report was submitted or, if not a City department, then to the chief controlling officer or officers of such other office or entity. A copy of such report shall also be furnished to the Director of the Mayor's Office of Construction for matters related to construction or to the Director of the Mayor's Office of Operations for all other matters.
