Continuation of the Agreement. Except as otherwise expressly set forth in this Amendment, all other terms and conditions of the Agreements remain in full force and effect without modification.
Continuation of the Agreement. After the expiry date of this Agreement and until a revised agreement is signed, this Agreement and all its provisions shall remain in full force and effect without prejudicing the position of the revised agreement in making any matter retroactive in such revised agreement.
Continuation of the Agreement. In all other respects the Agreement remains in full force and effect as originally executed and duly amended.
Continuation of the Agreement. The Agreement and this Amendment shall be read together and shall have the same force and effect as if the provisions of the Agreement and this Amendment were contained in one document. Continuation of the Agreement. Except as set forth in this Amendment, the provisions of the Agreement will remain in full force and effect, and, if there is a conflict between the terms of this Amendment and the terms of the Agreement, the terms of this Amendment will control.
Continuation of the Agreement. The terms of this agreement will continue to apply even though:
(a) the powers, duties and responsibilities of your Position are varied; or
(b) you are appointed to another Position under this agreement.
Continuation of the Agreement. 36.01 When notice to commence collective bargaining has been served under the Act, the Collective Agreement that applies to the parties at the time of service of the notice shall be deemed to continue to apply to the parties, notwithstanding any termination date in the agreement, until:
a) a new Collective Agreement is concluded, or
b) a strike or lockout commences under the Labour Relations Code. Whichever occurs first.
Continuation of the Agreement. If one Party terminates its participation in this Agreement for good cause or if its participation is terminated by any of the other Parties for good cause, this shall not automatically result in the termination of this Agreement. On the contrary, the Agreement may remain in force, either if the remaining Parties assume the contractual obligations of the withdrawing Party or if a new Party joins the Agreement. If one Party terminates this Agreement, the obligations (including, without limitation, Access Rights to Background Technology required for implementing the Project, confidentiality obligations, rights of first refusal) that were incurred prior to termination for the benefit of the remaining Parties, shall remain valid in any case, unless explicitly agreed otherwise with the other Parties upon withdrawal from the Agreement. The withdrawing Party shall have no Access Rights/shall maintain Access Rights with respect to Foreground that came into existence up until the day of its withdrawal. PLACE OF JURISDICTION, APPLICABLE LAW [The [exclusive] place of jurisdiction for any and all disputes arising from and in connection with this Agreement, including disputes as to its existence and disputes arising after its termination, shall be the court competent for commercial matters in _______(place). The Agreement shall be governed by Austrian law, excluding the conflict-of-law rules. Application of the United Nations Convention on Contracts for the International Sale of Goods shall be explicitly excluded. Continuation of the Agreement. The Agreement remains in full force as supplemented and amended by this SECOND AMENDMENT.
Continuation of the Agreement. Except as specifically amended herein, the Agreement is and shall continue to be in full force and effect and is hereby in all respects ratified and confirmed. This Amendment, including Exhibit 3, is intended to be and the parties agree that it constitutes a binding amendment of the Agreement as contemplated by Section 14 of the Agreement.
