Contracting Out—Entire Group/Family. The District will timely involve the Union in its determination on whether services are being provided effectively and competitively as part of its consideration of a possible decision to contract out an entire group/family of existing classified employee position(s). The District retains the right to decide to contract out the bargaining unit work without bargaining the decision. Before the District can make a decision to contract out an entire group/family of services, the District will inform the Union of its concerns about the operation of a service, which could result in contracting out work presently being performed by employees in the bargaining unit. Upon notification, the Union will have fifteen (15) business days to inform the District of its desire to be involved in the decision making process. If so, a joint task force will be formed to address the issue through an interest based process, which will include (at a minimum) the following steps: a. Problem definition; b. Data collection; c. Option development and evaluation, including allowing current employees a reasonable opportunity to develop an option for consideration by the task force; d. Consensus, if possible; and Implementation or referral. The joint task force may consider and, if mutually agreeable, implement or recommend options including, but limited to the following: a. Issue Request for Proposal (RFPs) to collect more data; b. Implement specific solutions agreed to by consensus; c. Recommend no change in operations; or d. Recommended contracting out The joint task force will complete its work within sixty (60) days of union notification. If after the completion of the interest based process, no consensus is reached and/or the District believes contracting out is the desired solution: a. The Union will have input into any bids let so long as it responds within timelines set by the District; b. The District will bargain with the Union as provided in section ORS 243.698 the impact of the decision; c. The Union will have the right to present a minority report to the school board for its consideration; and, d. The Union waives its right under ORS 243.698 to bargain the decision to contract out but retains its right to bargain over the impact of the decision.

  • Disputes between a Contracting Party and an Investor (1) Any dispute which may arise between an investor of one Contracting Party and the other Contracting Party in connection with an investment on the territory of that other Contracting Party shall be subject to negotiations between the parties in dispute.   • Access Toll Connecting Trunk Group Architecture 9.2.1 If CSTC chooses to subtend a Verizon access Tandem, CSTC’s NPA/NXX must be assigned by CSTC to subtend the same Verizon access Tandem that a Verizon NPA/NXX serving the same Rate Center Area subtends as identified in the LERG. 9.2.2 CSTC shall establish Access Toll Connecting Trunks pursuant to applicable access Tariffs by which it will provide Switched Exchange Access Services to Interexchange Carriers to enable such Interexchange Carriers to originate and terminate traffic to and from CSTC’s Customers. 9.2.3 The Access Toll Connecting Trunks shall be two-way trunks. Such trunks shall connect the End Office CSTC utilizes to provide Telephone Exchange Service and Switched Exchange Access to its Customers in a given LATA to the access Tandem(s) Verizon utilizes to provide Exchange Access in such LATA. 9.2.4 Access Toll Connecting Trunks shall be used solely for the transmission and routing of Exchange Access to allow CSTC’s Customers to connect to or be connected to the interexchange trunks of any Interexchange Carrier which is connected to a Verizon access Tandem.

  • CREDIT UNION LIABILITY FOR FAILURE TO MAKE TRANSFERS If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we may be liable for your losses or damages.
