Control Over Services. Partner acknowledges that (i) the Services and any related services may be subject to temporary shutdowns due to cause beyond Constant Contact's reasonable control; and (ii) subject to the terms of this Agreement, Constant Contact retains sole right and control over the development, content and conduct of its products and services.

Control Over Services. So long as during the Term Company does not materially decrease the functionality of Services as described in a proposal: (i) Company retains sole control over the operation, provision, maintenance, management, and performance of the Services, including the selection, deployment, modification and replacement of any software component of the Services, and maintenance, upgrades, corrections or repairs thereof; (ii) Company reserves the right to make any changes to any software component of the Services that it deems necessary or useful to maintain or enhance the quality or delivery of Company’s Services to its customers, the competitive strength of or market for Company’s Services, or the cost efficiency or performance of the Services; and (iii) Company may use global resources to provide Services and perform its obligations, unless otherwise expressly agreed.

The Connecting Transmission Owner for the Transmission District to which the wind generating plant will be interconnected and the wind plant Developer shall determine what SCADA information is essential for the proposed wind plant, taking into account the size of the plant and its characteristics, location, and importance in maintaining generation resource adequacy and transmission system reliability in its area.

  • Autism Services This plan covers the following services for the treatment of autism spectrum disorders. • Applied behavior analysis when provided and/or supervised by an individual licensed by the state in which the service is rendered. See the Summary of Medical Benefits for the amount that you pay. • Physical therapy, occupational therapy, and speech therapy services when rendered as part of the treatment of autism spectrum disorder. A benefit limit will not apply to these services. • Psychological and psychiatric services, and prescription drugs are also covered. See Behavioral Health Services and Prescription Drugs and Diabetic Equipment or Supplies for additional information. Coverage for autism spectrum disorders does not affect any obligation of a school district, a state or other governmental entity to provide services to an individual under an individualized family service plan, an individualized education program, or similar services required under state or federal law. Services related to autism that are furnished by school personnel are not covered under this plan.
