Costs Of Settlement Administrator. All Administration Costs shall be paid by Defendants out of the concurrent Xxxxx settlement as the cost of allocating said expenses would itself be prohibitively expensive. No amount shall be deducted from the Gross Cash Settlement Amount for costs of Settlement Administration in this case. The Settlement Administrator shall perform all necessary class administration duties, which shall include, without limitation, mailing notices and Claim Forms, performing address updates and verifications as necessary prior to the first mailing, mailing deficiency letters, performing a single skip trace on any returned mail for which a forwarding address has not been provided by the United States Postal Service, and the calculation, processing, and mailing of all Class Member settlement checks and 1099s, or other applicable tax forms, to Members of the Settlement Classes and tax authorities.

Costs Of Settlement Administrator. All Administrative Costs shall be paid from the Gross Cash Settlement Amount for costs of Settlement administration by the Settlement Administrator in this case which shall not exceed $75,000, subject to court approval. The Settlement Administrator shall perform all necessary class administration duties, which shall include, without limitation, mailing and emailing the Class Notice Documents, performing address updates and verifications as necessary prior to the first mailing, mailing and emailing deficiency letters, performing a single skip trace on any returned mail for which a forwarding address has not been provided by the United States Postal Service, the calculation and payment of all payroll taxes, and the calculation, processing, and mailing of all Participating Class Member settlement checks, 1099s and W-2’s, or other applicable tax forms, to the Settlement Class and tax authorities.

  • Final Report by Settlement Administrator Within 10 days after the Administrator disburses all funds in the Gross Settlement Amount, the Administrator will provide Class Counsel and Defense Counsel with a final report detailing its disbursements by employee identification number only of all payments made under this Agreement. At least 15 days before any deadline set by the Court, the Administrator will prepare, and submit to Class Counsel and Defense Counsel, a signed declaration suitable for filing in Court attesting to its disbursement of all payments required under this Agreement. Class Counsel is responsible for filing the Administrator's declaration in Court.

  • Settlement Administration The Settlement Administrator will conduct a skip trace for the address of all former employee Class Members. The Settlement Administrator will mail the Notice by first class U.S. mail to all Class Members at the address Defendants have on file for those Class Members and to all former employee Class Members at the address resulting from the skip trace. The Notice will inform Class Members that they have until the Response Deadline to either object to the Settlement or to opt-out of the Settlement. Any Class Member who does not receive Notice after the steps outlined above have been taken will still be bound by the Settlement and/or judgment.
