Common use of Court Subpoena Clause in Contracts

Court Subpoena. An employee who is subpoenaed to appear as a witness in court in a criminal proceeding, during any work day, shall receive full compensation for the time absent from work. An employee subpoenaed by East Xxxxx County Schools to appear as a witness in court in a civil proceeding during any work day shall receive full compensation for the time absent from work. An employee subpoenaed by someone other than East Xxxxx County Schools to appear as a witness in court in a civil proceeding during any work day may receive full compensation for the time absent from work, at the discretion of the Superintendent. However, if the employee is subpoenaed by the Association in a suit against East Xxxxx County Schools, then the employee will receive no compensation for the time absent from work.
