Coverage and Data Transmission. The Equipment, Service, and the Supplier's continuing obligation to provide same, are dependent on the availability and coverage of wireless networks, and the availability of positioning systems and the Internet, which are owned and operated by third parties. Wireless coverage areas are approximate and do not cover significant portions of Australia. The Supplier will not be responsible for the unavailability, termination or performance degradation of or limits in wireless networks, wireless coverage, positioning systems or the Internet. The Customer shall be solely responsible for obtaining wireless data transmission services under service plan(s) and from such wireless carrier(s) as may be designated by the Supplier, and for maintaining such wireless data transmission services.

Coverage and Data Transmission. The access and use of the Communication Network, Global Position System (“GPS”) network, and the Internet are dependent on the coverage and calling areas of networks owned by, operated by, and under sole control of third parties, and are made available to Client, subject to availability, over which Pedigree assumes no control. Client acknowledges that Pedigree is not responsible for limits in Communication Network coverage, loss of GPS signal or internet accessibility, due to (i) environment variables or performance degradation; (ii) due to any actions of third-parties outside the control of Pedigree; or (iii) transmissions from Hardware antennae that have an obstructed view of the sky, are in enclosed spaces, in buildings, between tall buildings, underground or in canyons or similar line of sight obstructions.

Trimble will not be responsible for the unavailability, termination or performance degradation of or limits in wireless networks, wireless coverage, positioning systems or the Internet which may affect use of Company’s Application Service by an End User.

Any service interruption as a result of the aforementioned does not diminish or impact Partner or End User from the obligation to make payment for Services.

Coverage and calling areas are approximate and do not cover significant portions of the United States or Japan. Actual coverage and operation of the Hardware depends on system availability and capacity, system and equipment upgrades, repairs, maintenance, modifications and relocation, equipment, terrain, signal strength, structural conditions, weather and atmospheric conditions, governmental regulations, suspected fraudulent activities, acts of God and other conditions beyond @Road's reasonable control. @Road will not be responsible for limits in coverage or performance degradation due to any such conditions. Hitachi Software acknowledges that coverage and calling areas may be interrupted, halted, or curtailed or the quality of the transmission may be diminished at any time. The Hardware and the FleetASAP service are dependent upon the availability of the Internet, which is owned and operated by and accessed through third parties.

  • Data Transmission The procedures for transmitting load obligation data to PJM for DS Supplier’s DS Load shall be as set forth by PJM.

  • Loop Transmission Types 3.1 Subject to the conditions set forth in Section 1 of this Attachment, Verizon shall allow CBB to access Loops unbundled from local switching and local transport, in accordance with this Section 3 and the rates and charges provided in the Pricing Attachment. Verizon shall allow CBB access to Loops in accordance with, but only to extent required by, Applicable Law. The available Loop types are as set forth below:

Encryption can be end to end at the network level, or the data files containing PHI can be encrypted.   • Information Transmission The Provider, on behalf of itself and its respective Subsidiaries, shall use commercially reasonable efforts to provide or make available, or cause to be provided or made available, to the Recipient, in accordance with Section 6.1 of the Separation and Distribution Agreement, any Information received or computed by the Provider for the benefit of the Recipient concerning the relevant Service during the Service Period; provided, however, that, except as otherwise agreed to in writing by the Parties (a) the Provider shall not have any obligation to provide, or cause to be provided, Information in any non-standard format, (b) the Provider and its Subsidiaries shall be reimbursed for their reasonable costs in accordance with Section 6.3 of the Separation and Distribution Agreement for creating, gathering, copying, transporting and otherwise providing such Information, and (c) the Provider shall use commercially reasonable efforts to maintain any such Information in accordance with Section 6.4 of the Separation and Distribution Agreement.

  • Transmission The Custodian and the Fund shall comply with SWIFT’s authentication procedures. The Custodian will act on FT Instructions received via SWIFT provided the instruction is authenticated by the SWIFT system. § Written Instructions. Instructions may be transmitted in an original writing that bears the manual signature of an Authorized Person(s).

  • Connecting Transmission Owner’s Attachment Facilities Connecting Transmission Owner shall design, procure, construct, install, own and/or control the Connecting Transmission Owner’s Attachment Facilities described in Appendix A hereto, at the sole expense of the Developer.

  • Errors in Transmission By using the Services you accept the risk that an item may be intercepted or misdirected during transmission. The Bank bears no liability to you or others for any such intercepted or misdirected items or information disclosed through such errors.

  • NYISO and Connecting Transmission Owner Obligations Connecting Transmission Owner and NYISO shall cause the New York State Transmission System and the Connecting Transmission Owner’s Attachment Facilities to be operated, maintained and controlled in a safe and reliable manner in accordance with this Agreement and the NYISO Tariffs. Connecting Transmission Owner and NYISO may provide operating instructions to Developer consistent with this Agreement, NYISO procedures and Connecting Transmission Owner’s operating protocols and procedures as they may change from time to time. Connecting Transmission Owner and NYISO will consider changes to their respective operating protocols and procedures proposed by Developer.

  • Information Submission by Connecting Transmission Owner The initial information submission by Connecting Transmission Owner shall occur no later than one hundred eighty (180) Calendar Days prior to Trial Operation and shall include New York State Transmission System information necessary to allow the Developer to select equipment and meet any system protection and stability requirements, unless otherwise mutually agreed to by the Developer and Connecting Transmission Owner. On a monthly basis Connecting Transmission Owner shall provide Developer and NYISO a status report on the construction and installation of Connecting Transmission Owner’s Attachment Facilities and System Upgrade Facilities and System Deliverability Upgrades, including, but not limited to, the following information: (1) progress to date; (2) a description of the activities since the last report; (3) a description of the action items for the next period; and (4) the delivery status of equipment ordered.
