DATA MANAGEMENT AND CONFIDENTIALITY. 3.1 Data Handling: GemCloud acknowledges that in the performance of this Agreement it will receive, use, and maintain "Data" provided by the Client, and agrees that it shall comply with any applicable privacy or security law or regulation governing the Platform’s use, disclosure, and maintenance, and with the rules fixed in this Agreement.

DATA MANAGEMENT AND CONFIDENTIALITY. The Provider shall comply with the terms, conditions, and obligations relating to the privacy, security, and management of personal and other confidential information applicable to the Provider under this Contract, including, with respect to the performance of Administrative Activities hereunder, those set forth in Appendix A attached hereto and incorporated herein by reference, as well as any other laws, regulations and other legal obligations regarding the privacy and security of such information to which Provider is subject, including those set forth in any Trading Partner Agreement with EOHHS.
