Debt Rescheduling. (i) Promptly upon the Buyer commencing negotiations with one or more of its significant creditors with a view to general readjustment or rescheduling of all or any material part of its indebtedness under circumstances in which a reasonable business person, in the exercise of prudent business judgment, would conclude that the Buyer would otherwise not be able to pay such indebtedness as it falls due, notice of commencement of such negotiations, and (ii) thereafter timely advice of the progress of such negotiations until such negotiations are terminated or completed.

Debt Rescheduling. 1. In the event of a request for debt rescheduling from the buyer´s/borrower´s country, the Insurer and Reinsurer shall consult as to how to resolve any problems that may arise by such a request. However, the final decision will be taken by the Insurer. 2. If the Policy forms part of a rescheduling agreement, the Insurer shall consult the Reinsurer if he wishes to sell or write off any of the debt relating to the Policy, and may at the Reinsurer´s request consider the assignment of the reinsured portion of the debt to which the Policy relates.

If a debt to which the Policy relates is made subject to a rescheduling agreement and if the reinsured portion of the debt to which the Policy relates has not already been assigned to the Reinsurer by the Insurer, the Insurer shall consult the Reinsurer and obtain the Reinsurer´s consent to any decision to sell or write off any portion of the debt relating to the Policy. Should the Insurer and the Reinsurer fail to agree on an any matter relating to the rescheduling agreement or on any decision to sell or write off such a debt, the Insurer shall, at the Reinsurer’s request, and expense, to the extent that no prejudice is caused to any security granted in relation to such debt, assign to the Reinsurer the reinsured portion of the debt to which the Policy relates and all rights pertaining thereto.

In the event of a request by the borrower´s country to reschedule the debt to which a Policy relates, the Insurer and Reinsurer shall consult as to whether to grant the request and if so how to resolve any problems that may arise from the request. However, in the absence of agreement the final decision will be taken in each case by the Insurer. 2. If the debt to which a Policy relates is made subject to a rescheduling agreement, the Insurer shall consult the Reinsurer if he wishes to sell or write off the reinsured portion of the debt or any part thereof, and may at the Reinsurer´s request consider the assignment to the Reinsurer of the reinsured portion of the debt or any part thereof. However if the debt is included in a Paris Club Rescheduling Agreement, it is expected that the reinsured portion would be treated in terms as favourable as that described in the Paris Club Agreed Minutes.

  • Rescheduling (a) A Maintenance Outage and the associated Capacity Credit Period may be rescheduled if Seller’s request to reschedule is received by Buyer no later than 5:00 p.m. PPT on the day before the Maintenance Outage was previously scheduled to begin. (b) A Major Overhaul and the associated Capacity Credit Period may be rescheduled provided: (i) The rescheduled Major Xxxxxxxx begins six months or more after the first outage notification date and time; (ii) The notification to reschedule is made at least one week before the Major Overhaul was previously scheduled to begin; and (iii) There is at least a one-month period between the notification to reschedule and the commencement of the rescheduled Major Overhaul. (c) Maintenance Outages and Major Overhauls may be rescheduled more than once.

  • Rescheduling of Tests If the Authority’s Engineer certifies to the Authority and the Contractor that it is unable to issue the Completion Certificate, as the case may be, because of events or circumstances on account of which the Tests could not be held or had to be suspended, the Contractor shall be entitled to re-schedule the Tests and hold the same as soon as reasonably practicable.

  • Self Scheduling The Home and the Union may agree to implement a self-scheduling process. Self-scheduling is the mechanism by which employees in a Home create their own work schedules. The purpose of self scheduling is to improve job satisfaction and quality of work life for the participating employees. Self scheduling requires a collaboration of employees and management to ensure proper coverage of the Home and to meet the provisions of the Collective Agreement. It is agreed that self scheduling will be negotiated locally by the Home and the Union and will include a trial period. Each Home must have the majority agreement of the full-time and part-time employees who vote on the issue to agree on a trial period of up to six months. Once the trial period is complete, each Home must have a minimum of 66⅔% agreement of the full-time and part-time employees who vote on the issue to continue with the new schedule on a permanent basis.

  • FINANCIAL SUPPORT 3.1 The individual support from Erasmus+ EU funds for the mobility period is EUR […], corresponding to EUR […] per month and EUR […] per extra days. The final amount of Erasmus+ EU funds for the mobility period shall be determined by multiplying the number of months of the mobility covered by Erasmus+ EU funds specified in article 2.4 with the rate applicable per month for the receiving country concerned. In such case, the institution shall ensure that the provision of services will meet the necessary quality and safety standards.] 3.3 The reimbursement of costs incurred in connection with special needs, when applicable, shall be based on the supporting documents provided by the participant. 3.4 The financial support may not be used to cover similar costs already funded by EU funds. 3.5 Notwithstanding article 3.4, the grant is compatible with any other source of funding including revenue that the participant could receive working beyond his/her studies/traineeship as long as he/she carries out the activities foreseen in Annex I. 3.6 The financial support or part thereof shall be repaid if the participant does not carry out the mobility activity in compliance with the terms of the agreement [NA to complete with specific recovery rules if needed]. If the participant terminates the agreement before it ends, he/she shall have to refund the amount of the grant already paid, except if agreed differently with the institution. However, when the participant has been prevented from completing his/her mobility activities as described in Annex I due to force majeure, he/she shall be entitled to receive at least the amount of the grant corresponding to the actual duration of the mobility period. Any remaining funds shall have to be refunded, except if agreed differently with the institution. Such cases shall be reported by the institution and accepted by the National Agency.

  • Scheduling i) The designated employer will provide the employee with their schedule of shifts in accordance with the collective agreement for both homes. (c) Employees may request pursuant to Article 13.08 to have the weekend off prior to or following their vacation. The Employer will endeavour to schedule such request subject to the following: i) Where the weekend off is granted and the employee was otherwise scheduled to work on those days, such extra days will be deemed to be vacation days; ii) The employee must have such vacation entitlement available; and, iii) The weekend off being requested must be contiguous with (i.e. consecutive with) the employee’s original vacation. (d) Prior to leaving on vacation, an employee shall be notified of the date on which to report back for work following vacation if the posted work schedule does not cover the employees’ vacation period, if the information is known to the employer. (e) Full-time employees will be granted time off in single days or multiples thereof upon request, provided the employer agrees to that request. The maximum allotment of these days will be five (5) days.

  • Scheduling Vacations Vacations are to be scheduled in advance and taken at such reasonable times as approved by the employee's department with particular regard to the needs of the Employer, seniority of employee, and, insofar as practicable, with regard to the wishes of the employee. F) Employees may, prior to the scheduling of vacations, request to have their vacations scheduled in accordance with either the principle of seniority or on a rotating basis. Where a consensus of employees cannot be reached as above, vacations shall be scheduled according to seniority on the basis that the employees with the most seniority shall have the first choice of vacation times. Employees failing to exercise their rights within the vacation selection time posted by the Employer shall forfeit their seniority rights in respect to choice of vacation time. G) Vacation time may be divided and shall be scheduled at a time mutually agreeable to the employee and the Employer, however, an employee who splits her vacation shall not receive her choice of when she wishes to take the subsequent portion of her vacation until all other employees in the unit or xxxx have made their first choice of vacation time.
