Defective Work Costs. Developer acknowledges and agrees that defective work costs as provided in Section 12.3 of this Agreement shall not be a Reimbursable Cost.

Defective Work Costs. (i) Contractor may use the Allocation to rectify Defective Work; provided, however, (i) that such Defective Work was not caused by Contractor’s failure to meet the Standard of Care, and (ii) Contractor’s use of the Allocation for rectification of Defective Work is limited to [*****] in the aggregate (except that any costs of rectification recovered by Contractor from insurance, sureties, Subcontractors, suppliers or others will be credited to the Allocation and the [*****] limit).
