Delivery Costs and Charges. Seller shall be responsible for paying or satisfying when due all costs or charges imposed in connection with the scheduling and delivery of Net Output up to and at the Point of Delivery, including but not limited to transmission costs and transmission line losses. Seller shall bear all costs associated with the modifications to Interconnection Facilities or Transmission Provider’s System (including but not limited to system upgrades) caused by or related to (a) the interconnection of the Facility with Transmission Provider’s System and (b) any increase in generating capacity of the Facility. This Section 5.2 shall not affect Seller’s rights to receive transmission credits or other payments from Transmission Provider required under the Generation Interconnection Agreement or otherwise under Requirements of Law, nor shall this Section 5.2 be construed to modify any allocation of Sales Taxes between Seller and PacifiCorp provided in Section 5.4.

  • Costs and Charges 8.19.1 To protect the Landlord from loss arising from a claim that may be brought against the Tenant as a consequence of a breach by the Tenant of any covenant contained in this Agreement. Such loss shall be deemed to include any charges which the Landlord may reasonably incur in connection with proceedings in a court of law against the Tenant but without prejudice to a Tenant’s right to have such costs assessed by the relevant court.
