DELIVERY TERMS AND DELIVERY TIME. 1The terms of supply and delivery of the Machine shall be DAP at ISR’s Site, and subject to the expressed terms and conditions defined herein in this Agreement (the "Delivery Terms").

DELIVERY TERMS AND DELIVERY TIME. 10.1 The terms of supply and delivery of the BRM shall be DAP at ISR’s Site, and subject to the expressed terms and conditions defined herein in this Agreement (the "Delivery Terms"). 10.2 The time for delivery of the 3 (three) BRM shall not exceed 17 (seventeen) months following the issuance of a Purchase Order ("Delivery Time"). Any unjustifiable delay of ISR in procurement of the Down Payment (Section 9.1) and/or Second Payment (Section9.2) shall extend the Delivery Time accordingly. 10.3 As an integral part of the delivery of the BRM and concurrently with the supply of the BRM, Supplier shall supply to ISR on DAP terms to ISR Site the complete and full set of all Spare Parts for Preventive Maintenance and Calibration for all 3 (three) BRM to for the be carried out during the entire Warranty Period. The Delivery Terms and Delivery Time of the BRM shall apply mutatis mutandis to the Spare Parts for Preventive Maintenance and Calibration. 10.4 At least 60 days prior to Delivery Time, Supplier shall submit to ISR the documentation detailed in Section 10 of the Technical Specifications. 10.5 It is hereby stated by Supplier and mutually understood by the Parties, that notwithstanding the Delivery Time, Supplier shall make its best efforts, in order to shorten the Delivery Time, as much as possible.

DELIVERY TERMS AND DELIVERY TIME. 13.1 The terms of supply and delivery of the Goods shall be DAP at ISR’s Site (the "Delivery Terms"), subject to Section 13.2. 13.2 The Delivery Time of the Goods shall be at Site (DAP) no later than fourteen (14) days following the issuance of an UTEX Order (the "Delivery Time"). 13.3 Following the receipt of a Refurbished Armature from Supplier, ISR shall make an ISR'S Armature available to Supplier on Site subject to the terms of this Section. 13.4 ISR'S Armature shall be provided to Supplier "As Is" without any warranties including with regards to merchantability, fitness or no infringement. 13.5 All shipping costs and expenses (including packaging, collecting, delivering) risks and insurance of Refurbished Armature and ISR'S Armature (both for shipping from ISR to Supplier and from Supplier to ISR) shall be borne by Supplier at its sole expense. 13.6 ISR makes no warranties, express or implied, including any warranty of merchantability or fitness of the ISR'S Armatures to be provided by ISR to the Supplier under the UTEX Transaction for any use. Supplier shall take responsibility for the use of the ISR'S Armature received from ISR by itself and/or by any third party. Supplier assumes, and shall be solely responsible, and fully releases ISR and anyone on its behalf from any liability or warranty, explicit or implied, in connection with any damage, including indirect, ancillary or consequential damage (“Damage”), in the wake of and/or in consequence of and/or in connection with and/or arising from the fact that any or all representations set forth above are found to be incorrect; and / or Damage caused by use of the ISR's Armature and /or any other use thereof

DELIVERY TERMS AND DELIVERY TIME. 10.1 The terms of supply and delivery of the TCTW shall be DAP at ISR’s Site, and subject to the expressed terms and conditions defined herein in this Agreement (the "Delivery Terms"). 10.2 The time of delivery for of the TCTW shall not exceed fourteen (14) months following the issuance of the Purchase Order ("Delivery Time"). 10.3 Any unjustifiable delay of ISR in procurement of the Down Payment (Section 9.1) and/or Second Payment (Section9.2) shall extend the Delivery Time accordingly. 10.4 As an integral part of the delivery of the TCTW and concurrently with the supply of the TCTW, Supplier shall supply to ISR on DAP terms to ISR Site (i) the complete and full set of all Spare Parts for Preventive Maintenance and Calibration for all TCTW to for the be carried out during the Warranty Period. The Delivery Terms and Delivery Time of the TCTW shall apply mutatis mutandis to the Spare Parts for Preventive Maintenance and Calibration (ii) a detailed and comprehensive maintenance plan for 20 (twenty) years of the preventive maintenance of the TCTW to be approved by ISR in writing and in advance ("Maintenance Plan"). For the avoidance of any doubt, Supplier shall not be entitled to Final Acceptance Certificate unless it provides ISR with all of the Spare Parts List (which include the Spare Parts for Preventive Maintenance and Calibration) and the Maintenance Plan. 10.5 At least sixty (60) days prior to Delivery Time, Supplier shall submit to ISR the documentation detailed in Section 17 of the Technical Specifications. 10.6 It is hereby stated by Supplier and mutually understood by the Parties, that notwithstanding the Delivery Time, Supplier shall make its best efforts, in order to shorten the Delivery Time, as much as possible.

DELIVERY TERMS AND DELIVERY TIME. 10.1 The terms of supply and delivery of the TTS shall be DAP at each of the Site, and subject to the terms and conditions defined herein in this Agreement (the "Delivery Terms"). 10.2 The delivery time of the TTS shall not exceed Ten Fourteen (1014) months following the issuance of a Purchase Order ("Delivery Time"). 10.3 Without derogating from the above, the detailed timetable for the supply, delivery, installation, commissioning and Qualification of the TTS shall be in accordance with the Technical Specification and/or the Milestone Documentation approved in writing by ISR. 10.4 It is hereby stated by the Supplier and mutually understood by the Parties, that notwithstanding the Delivery Time, the Supplier shall make its best efforts, in order to shorten the Delivery Time, as much as possible.

("Delivery Time").
